Here's a statement from the McCain-Palin camp on the report.

"Today's report shows that the Governor acted within her proper and lawful authority in the reassignment of Walt Monegan," said Palin spokeswoman Meg Stapelton. "The report also illustrates what we've known all along: this was a partisan led inquiry run by Obama supporters and the Palins were completely justified in their concern regarding Trooper Wooten given his violent and rogue behavior.

Lacking evidence to support the original Monegan allegation, the Legislative Council seriously overreached, making a tortured argument to find fault without basis in law or fact. The Governor is looking forward to cooperating with the Personnel Board and continuing her conversation with the American people regarding the important issues facing the country."

You can already see, in the McCain camp's first statement on the Trooper-Gate report, that the McCain campaign will spin it as actually letting Gov. Palin off the hook for firing Monegan because it finds that she had the power to fire him.

That's ridiculous. Monegan's firing was just the tip of the iceberg.

The report details the extraordinary lengths that Gov. Palin, largely through her husband Todd, went to get her ex-brother-in-law, a state trooper, fired because of personal family reasons (namely, his nasty divorce from Palin's sister). It was this effort, which led to pressure being improperly brought to bear on numerous state employees, that constituted an abuse of power by Palin. As it should be. State employees should not be subject to personal vendettas from elected officials.

While the report also finds that the governor in Alaska has the inherent power to fire her department heads for any reason or for no reason, it concludes that Monegan's refusal to fire one of his state troopers at the insistence of the governor and her family was a contributing factor in his own firing.

So rather than the firing of Monegan itself being the abuse of power, the wide-ranging effort to retaliate against her sister's ex-husband, of which Monegan's firing was merely a part, was the real abuse. Monegan's firing is evidence of the broader scheme, not the scheme itself. Cold comfort if you're a McCain-Palin supporter.

BEIJING — Chinese leaders are expected to allow peasants to buy or sell land-use rights for the first time, a step that could draw hundreds of millions of farmers more firmly into the market economy, now centered around the cities.

The new policy, which is being discussed this weekend by Communist Party leaders and could be announced within days, would be the biggest economic reform in many years and would mark another significant departure from the system of collective ownership and state control that China built after the 1949 revolution.

Party leaders began reviewing a draft of proposed rural land reform laws on Thursday at their annual planning session, now under way. Policy changes are expected to be announced after the session ends on Sunday, scholars and government advisers say.

The most important change would allow China’s peasantry, which by official count includes about 800 million people, to sell land-use contracts to other farmers or to agricultural companies. Some economists say this shift would lead to more efficient land use and allow much larger farms to be established.

The Chinese leadership has long insisted that the country must remain self-sufficient in the production of staple foods, and is highly unlikely to allow farmers to sell land-use rights for nonagricultural development. But if a market for trading farmland developed as expected, peasants could gain a new source of cash income that could help revitalize the stagnant rural economy.

“If all the speculations are true, if senior leadership is going to lift all the restrictions out the door, I’d say this is a great positive,” said Keliang Zhu, a lawyer with the China research division of the Rural Development Institute, a Seattle-based organization that has pushed for land rights for the rural poor. “It’ll free up the dead capital and allow all this wealth to materialize.”

Mr. Zhu added that the change would give China “huge momentum in terms of agricultural development.”

ANCHORAGE, Alaska - The politically charged investigation into Alaska Gov. Sarah Palin is over, and its conclusions are stinging. But the fallout, if any, might not come until Election Day.

A legislative investigator found that Palin violated state ethics laws and abused her power by trying to have her former brother-in-law fired as a state trooper.

The next move may be at the ballot box. The legislative committee that released the report Friday recommends no criminal investigation and has no authority to sanction the governor, the Republican vice presidential nominee.

"It is out of the Legislative Council's hands. It goes to anyone's hands who got a copy or clicks the link on the Web," said Democratic state Sen. Kim Elton, the chairman of the committee that released the report. "I can't tell you how the process ends."

If voters believe the report's finding and it tarnishes Palin's reputation as a reformer and a champion for good government, that could hurt Republican presidential nominee John McCain in the final weeks of the race.

The McCain campaign quickly rejected that notion.

"I think the American people can tell the difference between the results of a politically motivated investigation and a legitimate finding of fact," campaign spokesman Taylor Griffin said.

The inquiry looked into Palin's dismissal of Public Safety Commissioner Walter Monegan, who said he lost his job because he resisted pressure to fire a state trooper involved in a bitter divorce and custody battle with the governor's sister. Palin says Monegan was fired as part of a legitimate budget dispute.

Stephen Branchflower, a retired prosecutor hired to conduct the investigation, said Monegan's firing was lawful. But the pressure Palin and her husband put on him, he said, was not.

Under Alaska law, it is up to the state's Personnel Board, not the Legislature, to decide whether Palin violated the ethics laws. If so, it must refer the matter to the Senate president for disciplinary action. Violations also carry a possible fine of up to $5,000.

By the time that investigation is over, however, the election will be over. If Palin is the vice president-elect, the results will hardly matter. If she loses, she'll have to address the board's findings at home. The national media will be long gone.

Barack Obama's presidential campaign did not comment on the report amid persistent accusations by Republicans that rival operatives were manipulating the investigation to help the Democratic presidential nominee.

Democratic Sen. Hollis French, who oversaw the investigation, contributed to that perception when he said the report could provide an "October surprise" for the McCain campaign.

Elton said partisanship played no role in the report.

"When we began investigating this, we had no idea that Sarah Palin would be a part of the national ticket," said Elton, an Obama supporter.

Branchflower said Palin violated a statute of the Alaska Executive Branch Ethics Act. Lawmakers don't have the authority to sanction her for such a violation and they gave no indication they would take any action against her.

Palin has recently said that the Personnel Board inquiry is the only one that matters. And McCain's campaign echoed those comments Friday.

"This is the opinion of this Legislative Council investigation," Griffin said. "It's just an opinion."

The report notes a few instances in which Palin pressed the case against trooper Mike Wooten, but it was her husband, Todd, who led the charge. Todd Palin had extraordinary access to the governor's office and her closest advisers and he used that access to try to get Wooten fired.

Gov. Palin knowingly "permitted Todd to use the Governor's office and the resources of the Governor's office, including access to state employees, to continue to contact subordinate state employees in an effort to find some way to get Trooper Wooten fired," Branchflower's report reads.

Wooten had been in hot water before Palin became governor over allegations that he illegally shot a moose, drank beer in a patrol car and used a Taser on his stepson. The Palins said they feared for their family's safety after Wooten made threats against them.

JUNEAU, Alaska (AFP) - Democrat Barack Obama opened a double-digit lead over rival John McCain in a key opinion poll on Saturday while investigators found Republican vice presidential nominee Sarah Palin had abused her powers as Alaska governor.

Just over three weeks from the November 4 vote, Obama leads McCain 52 percent to 41 percent among registered voters, according to the latest survey conducted by Newsweek magazine.

A similar poll a month ago showed the two candidates tied at 46 percent.

As many as 86 percent of voters said they were dissatisfied with the way things were going in the United States, and only 10 percent said they were satisfied.

With voters preoccupied by the faltering economy, Obama has broadened his base of support. According to the survey, he now leads McCain among men 54 percent to 40 percent and women 50 percent to 41 percent.

Even those aged over 65, a formerly solid Republican constituency, now back Obama over McCain 49 to 43 percent.

After a thoroughly panned presidential debate, a wide-ranging coalition of activists on the left and the right is calling on Barack Obama and John McCain scrap the rules for the last presidential debate to avoid the stiff and scripted answers that many critics said deadened their earlier exchanges.

The group, which includes the likes of MoveOn, The Next Right, The Huffington Post and Wikipedia, sent a letter to the presidential candidates Friday pressuring them to change what they called a “lacking” debate that was lampooned as boring by Saturday Night Live.

At a minimum, the group demands that moderator Bob Schieffer be allowed to ask follow up questions to the candidates, who many believe have been allowed to skate through debates without being aggressively challenged on vague or non-responsive answers.

While the most recent debate did include questions from the Internet, the group is demanding that the candidate questioning be more transparent and accountable. To that end, the letter asks that questions be submitted and voted on online, and that the moderator be allowed “broad discretion” to follow up on the candidates' answers.

The final debate is Wednesday, Oct. 15.

CBS's Scott Conroy, traveling with Sarah Palin, has her seizing on one element of the Troopergate report (that she was within her right to fire Alaska's public safety commissioner) but ignoring another part (that she violated the state ethics code and abused her office by having her husband push to get their former brother-in-law fired):

PITTSBURGH — As she boarded her campaign bus this morning, Sarah Palin denied the conclusion of a state ethics report, which found the Alaska governor abused her power when she pressured subordinates to get a state trooper fired.

Asked by a reporter if she abused her power, Palin shook her head and said, "“No.”

She added, “And if you read the report, you’ll see that there was nothing unlawful or unethical about replacing a cabinet member. You got to read the report, sir.”

While the investigation by the Alaska state legislature did find that Palin was within her rights to fire public safety commissioner Walt Monegan — state trooper Michael Wooten’s boss — the report found that she violated the Alaska Executive Branch Ethics Act by knowingly allowing her husband Todd to use state resources to try to get Wooten fired.

The ethics report found that Gov. Palin “permitted Todd Palin to use the governor’s office and the resources of the governor’s office, including access to state employees, to continue to contact subordinate state employees in an effort to find some way to get Trooper Wooten fired.”

The report also found that Palin “knowingly permitted a situation to continue where impermissible pressure was placed on several subordinates in order to advance a personal agenda.”

The conclusion of the panel’s report endangered the Republican ticket’s argument that Palin has the track record to facilitate ethics reform in Washington.
