TUCSON, Ariz. – Dice-size crumbs of bright material have vanished from inside a trench where they were photographed by NASA's Phoenix Mars Lander four days ago, convincing scientists that the material was frozen water that vaporized after digging exposed it.

"It must be ice," said Phoenix Principal Investigator Peter Smith of the University of Arizona, Tucson. "These little clumps completely disappearing over the course of a few days, that is perfect evidence that it's ice. There had been some question whether the bright material was salt. Salt can't do that."

The chunks were left at the bottom of a trench informally called "Dodo-Goldilocks" when Phoenix's Robotic Arm enlarged that trench on June 15, during the 20th Martian day, or sol, since landing. Several were gone when Phoenix looked at the trench early today, on Sol 24.

Also early today, digging in a different trench, the Robotic Arm connected with a hard surface that has scientists excited about the prospect of next uncovering an icy layer.

The Phoenix science team spent Thursday analyzing new images and data successfully returned from the lander earlier in the day.

Studying the initial findings from the new "Snow White 2" trench, located to the right of "Snow White 1," Ray Arvidson of Washington University in St. Louis, co-investigator for the robotic arm, said, "We have dug a trench and uncovered a hard layer at the same depth as the ice layer in our other trench."

Habeas begins....imagine that....only in America

The Taliban tortured Abdul Rahim Abdul Razak al Ginco. They thought he was a U.S. spy. Then, U.S. soldiers called the Syrian native an enemy and shipped him to Guantanamo.

Now, Ginco will be turning a spotlight back on the Bush administration itself. Newly empowered by the Supreme Court, Ginco has become the first Guantanamo detainee to demand in a U.S. federal court that the military show the hard evidence that justifies his detention. Scores of others are expected to do likewise, attorneys predict.

The war on terror may never be the same.

On June 12, the court rewrote the rules for the Guantanamo detainees in the landmark case known as Boumediene v. Bush. The 5-4 majority opinion authored by Justice Anthony Kennedy concluded that the foreigners held at the U.S. Navy's Guantanamo Bay facility were protected by the U.S. Constitution's habeas corpus protections.

Hey, good news for US!

Superyacht Market Stays Strong

A new Superyachting Index shows that the top end of the yachting market is still holding firm – at least for now.

The index, which is compiled by The Luxury Institute and Camper & Nicholsons International – the yacht broker and charter company – found that new orders for yachts over 130 feet are up 18% in 2008. There were 254 new orders for yachts longer than 130-feet last year, up from 134 in 2005.

The report also puts into perspective the astounding growth rate over the past decade for jumbo yachts. In 1997, there were just 241 yachts of 80-feet or more under construction around the world. Last year, there were 916 such boats being built.

The average price for motoryachts longer than 100 feet was $10.3 million in 2007. The average price for sailing yachts of the same length was $9 million (although, to the dismay of traditionalists, sailing yachts now make up a tiny fraction of the large yacht market).

Ironically, the biggest constraint to the industry’s growth isn’t the economy — it’s staffing. The report says that about 25,000 crewmembers are necessary for today’s fleet of superyachts, but only about 15,000 currently work aboard yachts. Shortages of captains and engineers, it notes, are especially acute.

All of this sounds encouraging. And the superyacht market likely won’t face the same crash it experienced in previous downturns, since it’s so global. Just a decade ago, the vast majority of big boats were being purchased by Americans and Europeans. Now, Russian, Indian and Middle Eastern buyers are fueling the market.

Still, after talking with several yacht brokers last week about the market, I believe the market – at least in the U.S. – is poised for a slowdown. A year ago, buyers could order a new boat knowing that, in the worst case, they could flip it for a quick profit. Now they’re more hesitant.

“With the American market especially, people are waiting for more certainty in financial markets before make a big decision,” said Jonathen Beckett, CEO of Burgess.

ISLAMABAD: In a startling operation that shook the Pentagon, the White House and the US administration some weeks back, the Taliban in the tribal areas captured parts of three US helicopters — Chinook, Black Hawk and Cobra — while they were being shipped in huge containers from Peshawar to Jalalabad in Afghanistan.

Pakistani officials have confirmed the capture while the US diplomats stationed in Islamabad are trying to fudge the issue without denying it outright. US embassy spokesperson Elizabeth Colton commented: "The embassy has no comment on this as the information appears to be only hearsay."

When this correspondent informed the embassy spokesperson that he had seen pictures of the stolen parts of helicopters, she again said "no comment". Some diplomats in Islamabad are very much aware of this recent Taliban operation but they were not ready to speak on record.

Diplomatic sources say the recent US air strike in the tribal areas was actually an attack on the location where the unassembled parts of the two helicopters, owned by the US armed forces, were stored by the Taliban.

Sources told The News US Assistant Secretary Richard Boucher was to visit Pakistan and Afghanistan soon in view of the situation in the region. What is shocking is the revelation that the US forces were transporting helicopters in unassembled form in containers, which landed at the Karachi Port and travelled all the way by road to Peshawar and then entered the tribal areas for onward journey to Afghanistan.

When these containers entered the Khyber Agency at Jamrud, the Taliban stopped the convoys and took away the helicopter parts. Pakistani paramilitary forces in the area tried to confront the Taliban but they suffered heavy losses due to darkness. This happened in the same area where Pakistan's Ambassador to Afghanistan Tariq Azizuddin was kidnapped in February this year.

Chinook and Black Hawk were captured recently while the Cobra was hijacked some weeks back. When the Taliban first captured the Cobra helicopter, they filmed all the stolen parts and supplied the CD to their allies in Afghanistan.

Some people in the Farah province of western Afghanistan showed interest in purchasing the Cobra helicopter and subsequently its parts were smuggled to Farah. Taliban sold this Cobra to an unidentified customer for several hundred thousand dollars.

Following the latest ground hijacking, the Taliban have again filmed all the stolen parts of CH-47 Chinook and Black Hawk choppers. Chinook is a versatile twin-engine helicopter that was also used to help the earthquake victims in Kashmir in October 2005 by the US Army.

The Taliban have again sent the CD to people for attracting customers from neighbouring countries of Afghanistan. They do not seem to have hit any customer as the stolen parts with extra engines are still in their custody.

The Taliban captured some unexploded Tomahawk missiles in the Khost area of eastern Afghanistan in 1998. These missiles were fired on al-Qaeda hideouts after attacks on US embassies in Kenya and Tanzania. The Taliban handed over some of the unexploded US missiles to the Chinese in 1998.

Top US military officials have demanded recently from Pakistan to start an operation in the tribal areas for the recovery of their stolen helicopters. They have expressed concern that instead of initiating an operation against the Taliban, the new government is negotiating peace with the Taliban.

Concerned officials in the Foreign Office were of the opinion that the Taliban had increased their attacks in Afghanistan recently due to the incompetence of the Afghan National Army and the Nato forces.

The Taliban used a fuel tanker packed with 1800 kg of explosives a few days ago to break a jail in Kandahar. They got released their 400 comrades along with 1,100 other prisoners in that operation.

On Tuesday, the Taliban captured Arghundab district of Kandahar province. It was also a big blow to the credibility of Nato and the Karzai government but now both of them are trying to divert the international attention by threatening to attack the Pakistani border areas.

The Taliban have recently conducted bloody operations against the Nato forces in Shenwro district of Parwaon province in the north, Taren Kot city of Uruzgan province in the south and Poli Alm city of Logar province close to Kabul.

All these are not close to the Pakistani borders and the Taliban were attacking the Nato with the help of the local population.

It was learnt that the high command of Pakistani security forces has requested the government for permission to respond in a hard-hitting manner to any attack from Afghanistan in future.

Meanwhile, US Assistant Secretary of State Richard Boucher would visit Pakistan and Afghanistan shortly. It is expected that he would try to narrow down the differences between Islamabad and Kabul.

Britain is the world’s biggest arms exporter

London Britain was the world’s biggest arms seller last year, accounting for a third of global arms exports, the Government’s trade promotion organisation said.

UK Trade and Investment (UKTI) said that arms exporters had added £9.7 billion in new business last year, giving them a larger share of global arms exports than the United States.

“As demonstrated by this outstanding export performance, the UK has a first-class defence industry, with some of the world’s most technologically sophisticated companies,” Digby Jones, the Minister for Trade and Investment, said.

UKTI said that the figures were boosted by orders for Eurofighter Typhoon jets from Saudi Arabia, the world’s biggest arms buyer, which has imported $31 billion (£16 million) in weapons over the past five years. There were also orders from Oman and Trinidad and Tobago for offshore patrol vessels.

The US is still the world’s biggest exporter over the past five years, with $63 billion in total arms exports. Britain was second with $53 billion and Russia third with $33 billion.

Flipping a yacht for a quick profit is a misnomer. It is true that some boats have appreciated during certain time periods (when demand created a wait list for new boats).

For us mere mortals, a "quick profit" would translate to "we didn't lose as much money as we might have."

Boats of the motor yacht caliber are fully staffed all of the time. That's one expense.

They cost a lot of money to park dockside. That's another expense.

They require expensive repairs. That's another expense.

They cost millions of dollars to purchase. That's a lot of capital tied up in something that is unlikely to provide a return on investment comparable to investing the money elsewhere.

I doubt than there have been very many examples of owners, versus manufacturers and brokers, of "turning a profit" on these boats .

From what I've heard on MSNBC

the so called analysis, the repubs think he should have spoken up sooner and not wait to write the book. I can understand that to a point, but with this admin and it's backers, it was smart of him personally to write the book and get the press interested. Less likely for him to disappear or less likely for the repugs to start a campaign against Scotty.

Last night, this so-called compromise was voted out of committee and as early as this morning the bill may be brought to the House floor for a full vote.

Speaker Pelosi can still stop this bill.

As Speaker of the House, Nancy Pelosi can pull the bill from the floor and refuse to call a vote.

Call Speaker Pelosi right now and demand she stand up to President Bush and stop telecom immunity.

My observation of Scotty Testimony

First of all, who was that thug, Lamar Smith who was allowed to blather on his nonsense and character assassination. Doesn't Conyers have the right to step in and give some guidelines? Also what kind of testimony just gets started and recesses for another vote. Can't this committee start after the very important FISA bill vote? It's not like they didn't know that was coming. It really screws up the impact of the investigation. Now they are starting the FISA vote. Call your Congress person!!!

The Two Obamas

God, Republicans are saps. They think that they’re running against some academic liberal who wouldn’t wear flag pins on his lapel, whose wife isn’t proud of America and who went to some liberationist church where the pastor damned his own country. They think they’re running against some naïve university-town dreamer, the second coming of Adlai Stevenson.

But as recent weeks have made clear, Barack Obama is the most split-personality politician in the country today. On the one hand, there is Dr. Barack, the high-minded, Niebuhr-quoting speechifier who spent this past winter thrilling the Scarlett Johansson set and feeling the fierce urgency of now. But then on the other side, there’s Fast Eddie Obama, the promise-breaking, tough-minded Chicago pol who’d throw you under the truck for votes.

This guy is the whole Chicago package: an idealistic, lakefront liberal fronting a sharp-elbowed machine operator. He’s the only politician of our lifetime who is underestimated because he’s too intelligent. He speaks so calmly and polysyllabically that people fail to appreciate the Machiavellian ambition inside.

But he’s been giving us an education, for anybody who cares to pay attention. Just try to imagine Mister Rogers playing the agent Ari in “Entourage” and it all falls into place.

Back when he was in the Illinois State Senate, Dr. Barack could have taken positions on politically uncomfortable issues. But Fast Eddie Obama voted “present” nearly 130 times. From time to time, he threw his voting power under the truck.

Dr. Barack said he could no more disown the Rev. Jeremiah Wright than disown his own grandmother. Then the political costs of Rev. Wright escalated and Fast Eddie Obama threw Wright under the truck.

Dr. Barack could have been a workhorse senator. But primary candidates don’t do tough votes, so Fast Eddie Obama threw the workhorse duties under the truck.

Dr. Barack could have changed the way presidential campaigning works. John McCain offered to have a series of extended town-hall meetings around the country. But favored candidates don’t go in for unscripted free-range conversations. Fast Eddie Obama threw the new-politics mantra under the truck.

And then on Thursday, Fast Eddie Obama had his finest hour. Barack Obama has worked on political reform more than any other issue. He aspires to be to political reform what Bono is to fighting disease in Africa. He’s spent much of his career talking about how much he believes in public financing. In January 2007, he told Larry King that the public-financing system works. In February 2007, he challenged Republicans to limit their spending and vowed to do so along with them if he were the nominee. In February 2008, he said he would aggressively pursue spending limits. He answered a Midwest Democracy Network questionnaire by reminding everyone that he has been a longtime advocate of the public-financing system.

But Thursday, at the first breath of political inconvenience, Fast Eddie Obama threw public financing under the truck. In so doing, he probably dealt a death-blow to the cause of campaign-finance reform. And the only thing that changed between Thursday and when he lauded the system is that Obama’s got more money now.

And Fast Eddie Obama didn’t just sell out the primary cause of his life. He did it with style. He did it with a video so risibly insincere that somewhere down in the shadow world, Lee Atwater is gaping and applauding. Obama blamed the (so far marginal) Republican 527s. He claimed that private donations are really public financing. He made a cut-throat political calculation seem like Mother Teresa’s final steps to sainthood.

The media and the activists won’t care (they were only interested in campaign-finance reform only when the Republicans had more money). Meanwhile, Obama’s money is forever. He’s got an army of small donors and a phalanx of big money bundlers, including, according to The Washington Post, Kenneth Griffin of the Citadel Investment Group; Kirk Wager, a Florida trial lawyer; James Crown, a director of General Dynamics; and Neil Bluhm, a hotel, office and casino developer.

I have to admit, I’m ambivalent watching all this. On the one hand, Obama did sell out the primary cause of his professional life, all for a tiny political advantage. If he’ll sell that out, what won’t he sell out? On the other hand, global affairs ain’t beanbag. If we’re going to have a president who is going to go toe to toe with the likes of Vladimir Putin, maybe it is better that he should have a ruthlessly opportunist Fast Eddie Obama lurking inside.

All I know for sure is that this guy is no liberal goo-goo. Republicans keep calling him naïve. But naïve is the last word I’d use to describe Barack Obama. He’s the most effectively political creature we’ve seen in decades. Even Bill Clinton wasn’t smart enough to succeed in politics by pretending to renounce politics.

Bloomberg is speaking to members of a Jewish group in Boca Raton, Fla. He's warning them that the attempt to portray Obama as a shadowy Muslim with a hidden agenda often targets Jewish voters online and with e-mails.

The mayor says the deceptive campaign against Obama, who is a Christian, threatens to undo the strides that Jews and Muslims have made together.

The billionaire independent has not endorsed anyone yet in the presidential race. But his powerful defense of Obama Friday could help the Illinois senator in Florida, home to many Jewish voters.

Yes, John McCain has repeatedly stated that he didn't love our country until he was captured as a POW during Vietnam. Here's what McCain said in March on FOX:
"I didn't really love America until I was deprived of her company."
Then there's McCain in 1999:
"It wasn't until I was deprived of her company that I fell in love with America."
McCain was 31 years old when he was captured. 31. Far into adulthood. So McCain was fighting for our country, a country he didn't love. And we're supposed to respect the military service of a man who didn't love his country. Then why was he fighting?

How is this any different from what Michelle Obama said? Mrs. Obama said that for the first time in her adult life she really loves our country. McCain said that he never loved our country before the age of 31. At least Mrs. Obama did love our country before. McCain not so much. And another thing. Michelle Obama is the candidate's WIFE. John McCain wants to be commander in chief of a country he didn't love.

Deep down I don't disagree with her. The problem is that we need to get rid of the repubs rule to even grow some good 3rd parties. And how can you get a majprity of the people to go along with a 3rd party?

There is a debate going in my Il progressive group about thi right now.The Green party is beginning to grow in this area, so they are a part of our group. And they, like Alice, are pushing their presidential candidate.

Every other democracy in the world has governments that support more than 2 parties. If we want to survive in this country, it's time to catch up with the rest of the world. The people can pressure the two corporate controlled parties to open up the government to more than 2 parties, but it will take hard work and voting for OTHER parties.

Progressive party member:

But other nations have different electoral systems that make third parties viable. Australia, for example, has preferential voting - this makes it possible for third parties to exist as minorities with influence. The winner take all electoral system is the problem here - third parties cannot overcome that without massive support and they lack that.

It's been interesting to me to read these emails, and there are many. Wish they would start a blog.

Michael Greenburger is the man on oil speculation

Why is it so hard to figure out what's going on in commodities markets -- oil specifically?

Greenberger: Well, the reason it's hard to figure out is about 30 percent of our crude oil energy futures are traded in what is called a dark market -- that is a market that was deregulated in December of 2000 at the behest of Enron. Prior to that legislation being passed, all energy futures traded in the United States or affecting the United States in a significant fashion were regulated by United States regulators under a very careful regime that had been perfected over about 78 years and many observers believe that because those markets are not being policed, malpractices are being committed and traders are able to boost the price virtually at their will.

Ryssdal: You're not really telling me that seven years on, we're still paying the price for Enron, are you?

Greenberger: Well, this has been called the "Enron Loophole" and there are many legislators working very hard to close that loophole. There is tremendous concern about this on Capitol Hill and on a bipartisan basis, people are drafting legislation to try and get a handle on this and not eliminate speculation, but bring the speculation under the kind of time-tested controls that were used until Enron had its way and amended the law to escape traditional tested regulation on speculative activities.

Ryssdal: So what's Congress going to do? Congress is going to get together, they're going to pass a law and it's going to say, "CFTC, fix this?"

Greenberger: Well, there are several proposals suggesting or proposing that light shine on these dark markets and some of the legislation goes further than others, but the bottom line is the speculators will, in the end, be policed. We will know who they are, what they're doing, what their controls are, what effect they're having on the market. Maybe we'll find out that there's nothing there.

Ryssdal: So just to be clear, you do think that we're in a bubble, then?

Greenberger: I believe it and I'm certainly not alone in my belief. If you talk to anybody who trades in these markets on a regular basis, they will tell you that the markets are completely dysfunctional and out of control because of speculative activity.

Ryssdal: How long is it going to take then if we are, as you say, in a bubble, for it to work its way through and us to get back to something more realistic for the price of a barrel of oil, whether its 50 bucks or 80 bucks?

Greenberger: From my own experience as a commodity regulator, I believe that if the Bush Administration were serious about its regulation, we could begin seeing prices drop within a month. If we don't get the kind of regulation that has been done for decades and the market proceeds along the pace its proceeding, we will have to go through a very, very serious recession. The question is do you want to deflate the bubble by that kind of suffering or do you want to deflate the bubble by applying tight U.S. regulatory controls?

Ryssdal: Michael Greenberger used to run the Division of Trading and Markets for the Commodities Futures Trading Commission. He teaches law at the University of Maryland now. Mr. Greenberger, thanks a lot for your time.

Lamar Smith Compares McClellan To Judas, Declares ‘It’s Hard To Take Mr. McClellan Too Seriously’
Last month, former White House press secretary Scott McClellan published a memoir asserting that the Bush administration waged a “propaganda” campaign used to “sell the war” in Iraq to the public. He also said that Karl Rove and Scooter Libby deliberately sent him to the press to lie about their connection to the leak of covert CIA agent Valerie Plame’s identity.

Today, McClellan is testifying before the House Judiciary Committee. In his opening statement, the committee’s ranking member Rep. Lamar Smith (R-TX), one of Bush’s most loyal defenders, derided the hearing as the committee’s “first book-of-the-month-club meeting,” and suggested the next book should one by right-winger Ann Coulter. Lamar also compared McClellan to Judas, insisting he was “selling out the president” for “a few pieces of silver”:

SMITH: Welcome to the House Judicary Committee’s first book-of-the-month-club meeting. I propose that next time we consider Ann Coulter’s book, “How To Talk To A Liberal If You Must.” It’s hard to take Mr. McClellan or this hearing too seriously. … Scott McClellan alone will have to wrestle with whether it was worth selling out the president and his friends for a few pieces of silver.

There’s no comparison between Coulter — who never served in the administration — and McClellan, who was a member of Bush’s inner circle for most of the past decade. Later in the hearing, Rep. Jerrold Nadler (D-NY) apologized to McClellan for the “aspersions as to your motives…that we heard a few minutes ago.” “Such character assassination has no business in this committee,” Nadler said.

Lamar’s attempts to dismiss McClellan’s testimony echoes the strategy on the right to write off McClellan’s complaints as unimportant and disloyal. McClellan’s former boss Ari Fleischer insisted that only “Washington and people who follow Washington” cared about McClellan’s allegation. “I’m bored,” Bill O’Reilly complained, while Former House Speaker declared, “I’m more concerned about American Idol than I am about Scott McClellan.” White House officials also blasted him as a “traitor” and a “Benedict.”

Testifying before Congress today, Scott McClellan said Bush should not pardon Libby:

Mr. Chairman, I believe that it would signal a special treatment, the same thing that happened with the commutation. And the President has always held a certain standard for a granting pardons, even going back to when he was governor, and I worked for him then. And that is, that the person must first repay his debt to his society, and second, must express remorse for the crimes which he committed. And we have seen neither of that from Scooter Libby at this point.

The first thorough federal review of research on how global warming may affect extreme climate events in North America forecasts more drenching rains, parching droughts (especially in the Southwest), intense heat waves and stronger hurricanes if long-lived greenhouse gases continue building in the atmosphere.

The report is distinct from last month’s federal review of specific impacts of warming on agriculture, ecosystems, coasts and the like in the United States, focusing instead on how weather patterns will change. Chris Dodd (who was the recipient of a sweetheart deal on his mortgage from Countrywide, one of the beneficiaries of the bill) includes an attempt to sneak into law a requirement that all electronic payment processors send detailed transaction data to the federal government. The proposed law contains an exception for people with less than 200 transactions or a total value less than $10,000.

Quoting FreedomWorks chairman Dick Armey (former House majority leader) from the article: 'This is a provision with astonishing reach, and it was slipped into the bill just this week. Not only does it affect nearly every credit card transaction in America, such as Visa, MasterCard, Discover, and American Express, but the bill specifically targets payment systems like eBay's PayPal, Amazon, and Google Checkout that are used by many small online businesses. The Democrats are conceding defeat. The party’s top investigator in the House of Representatives acknowledges that there is nothing more he can do to force the vice president’s hand.
