A new born baby was found to be 15 times the adult drink drive limit after its Polish mother got drunk before the birth.
The mother was intoxicated during labor as she gave birth to a baby girl.
Doctors at a hospital in Otwock, on the outskirts of Warsaw, Poland called in police after the clearly-drunk expectant mother checked in to give birth on Monday.
Police spokeswoman Dorota Tietz said: "A blood test showed that the 38-year-old woman had a level of 1.2 gram of alcohol at the time of birth."
A level of 1.2 grams of alcohol per 1,000 gram of blood is the equivalent of a bottle of wine or two liters of beer for an adult drinker but its impact is compounded in a new born's tiny body.
As a result, the infant was found to have a level of 2.9 grams, police said.
The blood-alcohol limit for drivers in Poland is 0.2 grams.
The mother, who has not been named, could now face up to five years in prison on charges of having endangered the life and health of her child, Tietz said.
She added: "The baby's life is not in immediate danger but doctors fear the impact on her development."

David Iglesias, who was one of seven United States Attorneys fired by the Department of Justice for political reasons in December 2006, described his experiences to Jon Stewart on Monday’s Daily Show.
“They wanted us to file politically oriented prosecutions instead of just doing what our normal job is, which is enforce Federal law,” Iglesias stated, explaining that Justice Department higher-ups asked the US Attorneys “to file voter fraud prosecutions when the evidence wasn’t there beyond a reasonable doubt. It wasn’t just me. It was a guy in Missouri and it was a guy in Seattle, Washington.”
“What about the other 86 US Attorneys?” Stewart asked. “Are they doing those cases?”
“I want to give my colleagues the benefit of the doubt, with a couple of exceptions,” Igelsias replied cautiously. He mentioned former interim US Attorney Bradley Schlozman, who “could end up getting indicted” because “he rushed some voter fraud — ‘voter fraud’ — right before the election. … We can’t do that.”
“Talk about this other,” prompted Stewart. “There’s a case in Alabama, with the former governor of Alabama, Siegelman, who’s a Democrat, who was thrown in jail on charges brought up by the US Attorney’s office and then just let go.”
“Which is incredibly rare,” commented Iglesias. “Courts of appeal almost never release somebody while they’re serving time. … The court of appeals over in Alabama let Siegelman out — which tells me, really weak evidence.”
Iglesias then suggested it might be possible to go after the Justice Department officials who were ultimately responsible by “using the model we used against the Mob in the 60’s. You find a small fish, you threaten prosecution, you roll them, they give up the bigger fish.”
“It’s fascinating to know that we’re going to be treating this administration like the Gambinos,” remarked Stewart.
Stewart ended by asking Igleaias, “Is the greatest disappointment for you that you were a guy who believed in what they were doing? … Do you feel betrayed in that sense?”
“I thought I was working with the Jedi Knights and I was working for the Sith Lords,” Iglesias acknowledged, as the audience broke into applause.
“For the audience for this show, you could not have used a better example,” Stewart concluded. “I will see you at Comic-Con 2009.”

Steamed over a perceived increase in federal usurping of states' rights, Oklahoma's House of Representatives told Washington, D.C., to back off.
Joint House Resolution 1089, passed by an overwhelming 92-3 margin, reasserts Oklahoma's sovereignty under the Tenth Amendment to the U.S. Constitution, and, according to the resolution's own language, is "serving notice to the federal government to cease and desist certain mandates."
The Tenth Amendment states, "The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people."
Traditionally, this language has meant that the federal government is limited in its scope and cannot usurp the sovereign powers of states. In recent decades, however, as the size and reach of the federal government has expanded, many have come to question whether Washington has stepped on states' rights and gotten too big for its breeches.
Charles Key, the Republican state representative who authored the resolution, told WND that he introduced it because he believes the federal government's overstepping of its bounds has put our constitutional form of government in danger.
"The more we stand by and watch the federal government get involved in areas where it has no legal authority, we kill the Constitution a little at a time," he said. "The last few decades, the Constitution has been hanging by a thread."
Specifically, Resolution 1089 says the following:
"The State of Oklahoma hereby claims sovereignty under the Tenth Amendment to the Constitution of the United States over all powers not otherwise enumerated and granted to the federal government by the Constitution of the United States."
The resolution resolves that Oklahoma will "serve as notice and demand to the federal government, as our agent, to cease and desist, effective immediately, mandates that are beyond the scope of these constitutionally delegated powers."
It also instructs that "a copy of this resolution be distributed to the president of the United States, the president of the United States Senate, the speaker of the United States House of Representatives, the speaker of the House and the president of the Senate of each state's legislature of the United States of America, and each member of the Oklahoma congressional delegation."
The resolution does not, as some have speculated, amount to secession, but it does send a warning signal to Washington: Oklahoma does not intend to be bullied by big brother government.
The Sooner State became a hotbed of federal vs. state authority clashes earlier this month when a federal judge blocked a portion of Oklahoma's tough immigration laws, ruling that plaintiffs would likely establish that the state mandates preempted federal immigration laws.
Oklahoma's immigration statute, known as the Oklahoma Taxpayer and Citizen Protection Act of 2007, originated as House Bill 1804 (co-authored, incidentally, by Key). It has been characterized by USA Today as "arguably the nation's toughest state law targeting illegal immigration."
The statute prohibits illegal immigrants from receiving tax-supported services and makes it a state crime to transport or harbor illegal immigrants. It also mandates that businesses take measures to verify the work eligibility of employees and independent contractors.
The U.S. Chamber of Commerce and individual chambers of commerce in Oklahoma challenged the latter mandates, set to go into effect July 1, in court.
On June 4th, U.S. District Judge Robin J. Cauthron issued an injunction against enforcing the July 1 mandates.

The Democratic National Committee (DNC) announced Tuesday it will file a lawsuit in federal court next week to require the Federal Elections Committee (FEC) to investigate Sen. John McCain's (R-AZ) campaign for president since the DNC believes McCain illegally withdrew from a public financing agreement.
In its statement, the DNC said McCain illegally withdrew from an agreement with the FEC that holds him to spending limits and regulations. This agreement allowed McCain to receive matching funds, where any contributions up to $250 are matched from the Presidential Election Campaign Fund. Any dissolution of the agreement requires FEC consent.
The FEC currently does not have enough members to constitute a quorum but Chairman David Mason, a Republican, issued a letter to the campaign notifying it that it cannot withdraw without FEC approval. Mason also suggested the possibility that McCain has already benefited from matching funds, which is the position of the DNC, and may not qualify for FEC approval of contract withdrawal. In May, President Bush withdrew Mason's nomination to another term on the FEC, adding another questionable political firing under his belt.
In a conference call with reporters Tuesday, DNC legal counsel Joe Sandler explained that if the FEC did have enough members to meet and discuss McCain's request to withdraw from public financing, it should not find in McCain's favor. Sandler says a candidate cannot withdraw from the program if he or she has received funds or benefited from the FEC approval to receive public funds. The DNC alleges McCain did the latter, essentially using the rights to matching funds as collateral for a bank loan and thus benefited from them, eliminating his ability to withdraw. Sandler says McCain is not playing by the rules he helped create through the McCain-Feingold Law.
Sandler also indicated that he expects the nominations of five FEC commissioners to be confirmed soon, giving the Commission a functional six members, which would allow them to proceed. Sandler also expects a case involving a presidential candidate and the possible violation of the law would be a very high priority of the new commission. He also says however, that finding whether or not McCain's campaign violated federal election law "would require the FEC to act a lot more expeditiously" than it has in the past.
The DNC originally filed its suit in April but the court insisted they wait 120 days after the original complaint to the FEC had been made. That complaint was submitted in February and the DNC will file the suit on June 24, per court instructions.

Testifying before the committee, former Navy general counsel Alberto Mora, who battled within the Pentagon to shut down the use of torture, blasted the Bush administration’s abusive detention practices as leading to the recruitment of new radicals and the deaths of more American soldiers:

White House Derides Investigation That Exposed Drug Testing On Vets As ‘Irresponsible Reporting,’ ‘Awful’
Today, the Washington Times reported on the results of a joint investigation with ABC, which concluded that “mentally distressed veterans from Iraq and Afghanistan are being recruited for government tests on pharmaceutical drugs linked to suicide and other violent side effects.”
In studies with the anti-smoking drug Chantix, for example, the VA “took three months to alert its patients about severe mental side effects.” In today’s press briefing, however, White House spokesperson Tony Fratto called the investigation “irresponsible” journalism, complaining that he “had to watch” the “awful” reporting:
I saw the reporting in your paper and on I think it was ABC this morning. I thought actually some of it was some of the most — certainly at least what I saw on television this morning was some of the more irresponsible reporting that I’ve ever seen, in terms of taking what this one — the experience of this one veteran and trying to leave the impression that this was a situation for all veterans. […]
And to try to imply that — and, in fact, not even imply. I see the words scrolled on a television screen this morning that the V.A. is using our veterans as guinea pigs, I thought was one of the most awful things I’ve ever had to watch on television.

If Fratto read the story instead of simply catching the scroll on a television screen, he’d know that thousands are potentially affected. Roughly nearly 1,000 veterans were enrolled in anti-smoking studies, with 143 using Chantix; 21 veterans reported “adverse effects,” including one who suffered suicidal thoughts.
Furthermore, the VA and other agencies are currently conducting 25 tests on 4,796 veterans, “more than half of whom are just returning from the wars in Iraq and Afghanistan.”
Fratto also praised the “wonderful leadership” of VA Secretary James Peake, who recently said that concerns about post-traumatic stress disorder in veterans are “overblown“.

Appellate court tosses out key conviction in Abramoff case

WASHINGTON — A federal appeals court overturned the conviction of a former White House official Tuesday in a significant defeat for prosecutors who are overseeing the investigation into the Jack Abramoff influence-peddling scandal.
David Safavian was convicted in 2006 of four charges related to statements he made to officials who were investigating Abramoff, a former lobbyist who pleaded guilty to conspiring to bribe lawmakers and bilking his Indian-tribe clients out of millions of dollars.
The U.S. Court of Appeals for the District of Columbia Circuit threw out two felony-concealment charges against Safavian, saying he had "no legal duty to disclose" details about his relationship with Abramoff to General Services Administration ethics and inspector-general officials. At the time, Safavian was the GSA's chief of staff and helped Abramoff attempt to buy two GSA-managed properties in the Washington area.
"Attorneys commonly advise their clients to answer questions truthfully but not to volunteer information ... " the court wrote. "The government essentially asks us to hold that once an individual starts talking, he cannot stop."
The court also said that Safavian deserved a new trial on charges related to allegations that he obstructed investigators who'd been looking into a golfing trip he took with Abramoff in Scotland and that he lied to the Senate.
Laura Sweeney, a Justice Department spokeswoman, declined to comment on whether they'd retry Safavian. She said prosecutors were reviewing the ruling.
So far, Safavian is the only defendant in the Abramoff investigation to go to trial. Fourteen others have pleaded guilty, including Abramoff, who's serving six years in prison on unrelated charges.
Barbara Van Gelder, Safavian's defense attorney during the trial, said she thought that the Justice Department should dismiss the remaining charges. She accused prosecutors of overzealously pursuing Safavian, a longtime friend of Abramoff, contending that they wanted him to plead guilty and cooperate against other defendants whom he knew nothing about.
Safavian was sentenced to 18 months in prison, but his sentence had been put on hold until the outcome of his appeal. He's been disbarred from practicing law because of the allegations.
"He's suffered enough," Van Gelder said. "I hope prosecutors look at the decision and realize that they took an extreme and aggressive view and consider making a midcourse correction."
The court also said that the trial judge should have permitted defense attorneys to call experts to testify about the meaning of Safavian's statements, a development that his appellate attorney Larry Robbins said would strengthen his client's case if he were retried.
During the eight-day trial in 2006, prosecutors presented dozens of e-mails between Safavian and Abramoff discussing the GSA properties.
Abramoff contacted Safavian days after his old friend became GSA's chief of staff to talk to him about the properties, according to federal records.

Jean Schmidt Refuses To Retract False Claim That China Is ‘Drilling Off The Coast Of Florida’
On June 5, Rep. Jean Schmidt (R-OH) took to the House floor and criticized Congress for refusing to lift the ban on offshore oil drilling. To strengthen her point, she claimed that even China and Cuba are drilling off Florida’s coast:
This very day, there is indeed the drilling activity off of our country’s coast. Not by our U.S. companies; that would be illegal. Instead, the Chinese are drilling off the coast of Florida, with their new energy partner, Cuba. This Congress has failed to act time and time again. Our oil resources along our coastlines and in Alaska remain untapped in the name of environmentalism.

Schmidt’s allegation is false. China is not drilling off the coast of Florida. Even Vice President Cheney, who also made the claim last week, put out a statement on Thursday admitting that he was wrong:
It is our understanding that, although Cuba has leased out exploration blocks 60 miles off the coast of southern Florida, which is closer than American firms are allowed to operate in that area, no Chinese firm is drilling there.
Conservative columnist George Will, who also made the claim in his June 5 column, today wrote a correction, stating, “[N]o Chinese company has been involved in Cuba’s oil exploration that close to the United States.”
Schmidt and other conservatives are refusing to back down, however. When asked whether she plans to issue a retraction, one of her spokesmen simply replied, “We will have a discussion.” House Minority Leader John Boehner (R-OH), Minority Whip Roy Blunt (R-MO), and Rep. George Radanovich (R-CA), who also made the false claim, have gone further and defended their statements.
Similarly, other conservatives continue to peddle the propaganda. Just yesterday, conservative pundit Mary Matalin made the claim both on CNN and CNN Headline News. A Fox News guest also repeated the lie yesterday on Neil Cavuto’s show.

ThinkProgress spoke with a spokesman for Schmidt who said that the congresswoman is standing behind her statement and still believes that the "Communists understand" what the U.S. Congress doesn't -- "We need more oil exploration." He added that "it doesn't matter" which country is doing the drilling as long as Cuba continues to lease plots of land to foreign countries.

In a pathetic attempt to salvage what little credibility the 100 year old National Press Club has left following its decision to permit a known prevaricator and fabulist named Larry Sinclair to rent the Holeman Lounge press conference room for $3000 on Wednesday, June 18, and following MSNBC's Keith Olbermann's naming the National Press Club as his number 3 "Worst Persons in the World" in last night's telecast, the leadership of the National Press Club is scrambling to dig itself out of a hole of its own creation.
It is not the first time the NPC has gotten itself into trouble during this presidential election year. The decision to invite Senator Barack Obama's former Trinity United Church of Christ pastor Jeremiah Wright to speak at an official NPC breakfast conference on April 28 was done after at least two pro-Hillary Clinton members of the NPC's Speaker's Committee arranged for the Wright appearance to politically damage Obama before the Indiana and North Carolina primaries.
Many NPC officers are expressing ignorance about Larry Sinclair, who he is, and who he represents. Sinclair is a political bottom feeder, the type of person who comes to the attention of the Karl Roves and Roger Stones of the world to disparage political candidates without a shred of evidence. Sinclair is from Minnesota and claims to have given oral sex to Obama and used drugs with him in a limo in Chicago in 1999. Sinclair offers no proof or corroborating witnesses. Sinclair is even proffering the fantasy that Obama had something to do with the murder of Donald Young, Trinity's gay choir director, last December. Of course, murders in south Chicago are so rare that one would immediately suspect that a hooded albino priest covertly hired by the Obama campaign must have been the murderer.
Sinclair took two polygraph examinations administered by the website Whitehouse.com and failed them both. Sinclair's reaction: someone paid a $750,000 bribe to the website to alter the results. Uh hum. Tomorrow, Whitehouse.com will hold a press conference in the Lisagor Room on Sinclair's failed polygraph tests.
Sinclair's big media appearance, prior to the NPC conference, was on the Jeff Rense radio program, one of the only shows this editor has turned down for an interview since it delves into subjects that make the "X Files" look like a documentary.
Sinclair has accused the Obama campaign and the Secret Service with threatening him. Almost lost in the debate is the fact that Sinclair had an outstanding arrest warrant for felony fraud in Pueblo, Colorado. Sinclair's other resume grabbers: well, he is an ex-con, a one-time trafficker of drugs from Colorado to South Carolina, and a "coyote," a trafficker of human beings from Mexico into the United States. [Perhaps Sinclair should be asked tomorrow if he ever had a cocaine relationship with South Carolina's former Treasurer Thomas Ravenel, who was also Rudolph Giuliani's South Carolina presidential campaign chairman. Ravenel was convicted last year on federal charges of distribution of cocaine].
Sinclair even photo shopped an older picture of himself with a photo of Obama with his arm around him and holding a crack pipe and posted it on his website. But other than those issues, he is a fine person to stand underneath NPC seal and the imprimatur of the National Press Club on June 18.

Steve O'Hearn, the chair of the NPC's New Media Committee, asks why the NPC is being attacked for granting a venue for Sinclair, "But suddenly I’m rather curious that an organization like FireDogLake.com would be taking so much effort and going to so much trouble to collect tens of thousands of signatures and petitions and launching a barrage of phone calls against the National Press Club for the sole purpose of shutting down someone’s right to free speech." If Mr. O'Hearn used his "New Media" and did some homework, he would discover that it is not just FireDogLake that has called for people to protest to the NPC. This editor has linked to the petition drive by that website and has signed to petition against the Sinclair event. Other websites are following suit, especially after the Olbermann criticism of the NPC last night.
NPC President Sylvia Smith has claimed the following in an interview with Politico: "I’m not aware that we’ve ever turned anybody away for content.” As John McLaughlin of the McLaughlin Group might say, "Wrong, Sylvia!" Last year, NPC President Jerry Zremski, whose reportage for the Buffalo News gave a number of free passes to the GOP congressional staff cabal that was enmeshed in the House page sex scandal involving Rep. Mark Foley (R-FL), Rep. Tom Reynolds (R-NY), and Speaker Dennis Hastert, pressured the cancellation of an event featuring a group of Venezuelans representing President Hugo Chavez who had rented an NPC room. The scheduled event was, like the Sinclair press conference, not an official event of the NPC but one that the right-leaning NPC leadership saw fit to have canceled.
On the NPC blog, a former NPC member wrote the following cogent comment:
"I’m a former member of NPC, having worked in Washington some years back. Even had an office in your building. Used to attend meetings in the press club and hoist a few in the Reliable Source bar. Nice joint.
I genuinely appreciate the NPC’s commitment to freedom of expression, but the Larry Sinclair situation is not about that. There is no shortage of places for him to hold a press conference. The question is whether the NPC is obligated to let him use its facilities.
While it’s true that the NPC doesn’t endorse every group that rents a room, doing so does give some minimal legitimacy to those who appear there. After all, would the NPC rent a room so a Holocaust denial organization that wished to host a conference on Adolf Hitler’s birthday? I doubt it; you’d exercise some level of discretion, and you’d be within your rights to do so.
Larry Sinclair is a convicted criminal who has served prison time for fraud."
Tomorrow, this editor will be in the Holeman Lounge and ask Sinclair who is paying his freight and a follow up question, "What politicians have you blown recently?" Hopefully, that will pose a problem for the right-wing pro-family media outlets and their NPC friends who will be there salivating over Sinclair's salacious false charges against Obama.

half-dozen military helicopters flew low over parts of Denver Monday night as part of a security drill organized by the U.S. Department of Justice. Denver police said they were aware of the operation, but could provide no details.
The secret drills coincided with preparations for the Democratic National Convention, which will take place in Denver in late August. The Denver Post reported that the military aircraft “buzzed above the Pepsi Center,” the site of the convention.
A military spokesman, though insisted to the Rocky Mountain News that the military drills were unrelated to planning for the convention, which is expected to draw thousands of protesters as did the 2004 party conventions in Boston and New York.
“It’s nothing more than Special Operations Command training with local authorities,” said Lt. Nathan Potter, with Special Operations Command, which has authority over special forces from all branches of the military.
Potter would not say which branch of the military was flying the choppers over Denver.
The training has nothing to do with preparations for the Democratic National Convention, which will be held in Denver in August, Potter said.
“It’s routine preparation for the global war on terrorism,” he said.
The Rocky Mountain News also reports on further efforts by police to stock up on equipment to suppress potentially unruly protesters, including pepper-spray guns that fire plastic pellets filled with “power that’s ‘like a combination of cayenne pepper and baby powder,’” according to the manufacturer. The city itself is refusing to disclose details of its security preparations.
The city received a $50 million federal grant for security. A senior adviser to Mayor John Hickenlooper has said the city plans to spend up to half that amount on equipment, with the rest going to pay officers.
But the city has refused to disclose how it is spending the money, prompting the American Civil Liberties Union last month to file a civil lawsuit. …

Leading article: The tragic legacy of a disastrous president

It gets an outing on every visit of an American president to these shores. And yesterday's appearance of President George Bush in London, stopping by on his farewell tour of Europe, was no different. Both Gordon Brown and Mr Bush paid tribute to the "special" relationship between our two nations.
The "special relationship" is a concept that cuts little ice with hard-headed diplomats on both sides of the Atlantic. Yet it was once more than a platitude. While the default position of much of the world has traditionally been to look upon America with guarded scepticism, Britons (at least for the past century) have been instinctively well-disposed to the United States and its leaders. The bonds of a common language and a history of shared struggle in two world wars did indeed make this relationship something out of the ordinary.
So perhaps Mr Bush's most significant legacy, as far as Britain is concerned, will be the destruction of the instinctive trust of America and its leaders that once prevailed here. It is no exaggeration to say that Mr Bush has done more damage to relations between our two nations than any president in living memory. This rupture is not an accident of circumstance; there are no impersonal forces of history to blame. This sorry state of affairs is the consequence of the actions of a single leader and his small coterie of advisers.
America's invasion of Iraq must, of course, be recorded at the top of the charge sheet. In 2002, Tony Blair announced that he was prepared to pay "the blood price" for the sake of the special relationship. But it was not the then prime minister who paid it. That fate has, instead, fallen to 176 British troops who have lost their lives in Iraq.
Yet President's Bush's malign legacy is about much more than Iraq. Relations have been soured by the prolonged jailing of innocent Britons in Guantanamo Bay, the suspected use of Britain as a stopover point for CIA torture flights and a hopelessly one-sided extradition treaty. President Bush has even helped to undermine the peace dividend from the end of the Cold War. He has antagonised Russia by pushing America's missile defence shield project, an outpost of which is to be situated on British territory.
Of course, one might argue that the real culprit here is Mr Blair, who signed Britain up unquestioningly to President Bush's foreign-policy goals when he was in Downing Street. Mr Blair's burden of responsibility is undeniable. But it does not rescue Mr Bush from the abysmally low regard in which he is held by the majority of Britons. And with his disregard for international law, his arrogant refusal to build alliances, this President would have inspired fierce opposition here, even if Mr Blair had not committed Britain to the Iraq misadventure and the "war on terror".
In one sense, this is a discussion about history. Like all second-term American presidents, Mr Bush's power is waning by the day. His legacy will be for academics to debate. The pertinent question now is to what extent Mr Bush's huge unpopularity has contaminated wider public attitudes to America in Britain. Can a President Obama, or a President McCain, heal the wounds? Or is the damage permanent? One would have to suspect that the situation is recoverable; not least because America itself seems as eager for change as Britain. But whether the relationship will ever return to what it was pre-Bush, is another question entirely.
And whatever the future holds for transatlantic relations, there will be very few in this country who watched President Bush's plane depart yesterday without a feeling of profound relief that the end of this disastrous presidency is finally in sight.

Democratic presidential candidate Barack Obama had some strong criticisms for fathers who abandon their families. There is little doubt that Obama was referring to his Kenyan father, Barack Obama, Sr., who, according to the presidential candidate's first book, Dreams from My Father, writes that his father abandoned him at 2 years old, along with his mother, and returned to Kenya. Obama was raised by his mother's step-father, Lolo Soetoro, in Jakarta, Indonesia until the age of 10 and moved back to his native Hawaii where he was raised by his mother's parents.
Yesterday, WMR spoke at length with the former Prime Minister of a country that borders Kenya. The African political leader knew Barack Obama Sr. after his return to Kenya and paints quite a different picture of the father of the possible future president of the United States.
The former leader said he was in Nairobi and met Barack Obama Sr. and a number of meetings dealing with regional East African transportation issues. He said that he remembered the senior Obama as "very smart" and "impressive," adding that he spoke English with a heavy British accent. "Barack Obama was very well respected" by his colleagues, the former Prime Minister said.
The former Prime Minister said that at the time he knew Obama he had no idea that he had a son in the United States. He and Obama often left their technical meetings and had drinks at the bar of the Intercontinental Hotel in Nairobi. He revealed that Obama, who graduated with a PhD in economic mathematics from Harvard, expected to be given a high position in the newly-independent government of Kenya in 1964.
However, Obama was an ethnic Luo and the British colonial government and the Kikuyu-dominated government of Kenya's first President Jomo Kenyatta mistrusted the Luo because they felt they represented leftist views. Obama was a colleague of Kenya's first Vice President, Oginga Odinga, the late father of Kenya's current Prime Minister and opposition leader Raila Odinga. Oginga Odinga quit the Kenyatta government in 1966 and headed the opposition Kenya People's Union.
Obama's old friend said he was saddened to learn of Obama's death in a car accident in 1982 when he read the obituary in the East African Standard, Kenya's national newspaper. The senior Obama, disappointed that he was not given a significant job with his Harvard credentials because of discrimination by the dominant Kikuyu against the Luo, increasingly began drinking. The car accident that took life was blamed on drunk driving.
Obama's friend said that when he hears Barack Obama Jr. speak he hears the charismatic voice of his father. "Obama's father was a great orator in public meetings and privately," confided his friend. The former Prime Minister feels, in retrospect, that had Obama been given a high-level job in the Kenyan government, he would have brought his American wife and son to live with him in Kenya. His friend said that Obama Sr. seemed ashamed that he could not get a job commensurate with his education and credentials. "His Harvard degree was downplayed by the Kenyan government," said his friend.
WMR has not revealed the identity of the former Prime Minister, an exile from a U.S.-supported dictatorship in East Africa. If the relationship between the former Prime Minister and the father of the possible next President of the United States became known, it could result in problems with the dictator, a longtime client of the Clinton and Bush administrations.

The latest SurveyUSA poll in Kentucky shows Mitch McConnell leading his Democratic opponent, Bruce Lunsford, by just a 50% - 46% margin.
Mitch McConnell is in BIG trouble. He's already spent millions on t.v., which he started running last November according to the Associated Press -- yet, he's barely breaking 50%. Sure McConnell has a huge campaign war chest, but his opponent is a multi-millionaire who can self-finance part of the race.
Clearly, McConnell's obstructionist antics in the Senate aren't doing much for his stature in his home state. Let's hope Mitch keeps it up. He's going to have to work extra hard and spend even more money just to defend his own seat. And, it's not a sure thing at all. That means less time campaigning and raising money for his other endangered GOP colleagues.
There used to be an "unwritten rule" in the Senate that the leaders weren't targeted by leaders on the other side. That ended when the GOP went after Tom Daschle:
Senate Republican leaders broke an unwritten rule about campaigning directly against an opposition leader and targeted Daschle for defeat, charging that he was an obstructionist liberal in a moderate's clothing.

Quite the mensches, our friends at the Associated Press. They sent some bloggers a legal letter telling them that it's illegal for bloggers to quote anything - ANY THING - from an AP story on their blog. Even if the quotation comprises only 39 words, AP says it's illegal (it's not) and they're gonna sue you.
Yeah, that's nice.
Now let me show you what 39 words is. I'm reprinting, below, the first 39 words in this post:

Yes, according to the Associated Press, quoting two sentences (and two words) from any source at any time is illegal. Now, excuse my legal naivete since all I have is a simple J.D. from Georgetown, but what exactly is AP's legal argument for claiming that the "fair use" exemption to copyright law no longer exists and/or applies?
AP then says, fret not. They're going to "negotiate" with a group of bloggers no one has ever heard of, and come up with their own solution to this "problem." Uh, first off, until AP is confirmed to a seat on the Supreme Court, it doesn't matter what agreements they reach detailing what they think constitutes fair use (I guess AP now thinks they can issue signing statements too). Secondly, who is the "Media Bloggers Association" that AP is meeting with to iron out this deal on behalf of us all? I think I've vaguely heard of this group - they kind of waltz in whenever a mainstream trouble maker is looking for "normal" bloggers to deal with. The problem is, no one has a clue who these people are, and none of us ever picked them to be our representatives. So, go ahead and meet with them, AP. And while you're at it, be sure to meet with the Tooth Fairy as well. I understand habeas corpus needs some retooling.

WASHINGTON — The Supreme Court agreed Monday to decide whether top government officials can be sued for the alleged abuse of a Pakistani Muslim arrested and jailed after Sept. 11, 2001.
The case, arising from the federal roundup of Arab Muslims in New York after the terrorist attacks, could be an important test of the personal responsibility of high-ranking officials when subordinates violate constitutional rights.
The court agreed to hear an appeal from former attorney general John Ashcroft and FBI Director Robert Mueller of a ruling that allowed a lawsuit against them to proceed.
Federal agents arrested Javaid Iqbal at his Long Island home in late 2001 and held him from January to July 2002 in a federal detention unit in Brooklyn. Iqbal alleges he was kept in solitary confinement, beaten and subjected to abusive strip searches. He claims he was picked up and categorized "of high interest" to the Sept. 11 investigations solely because of his race, religion and national origin.
After he was released and deported to Pakistan, Iqbal sued numerous federal officials, including Ashcroft and Mueller, claiming they violated his civil rights. He sought damages and attorneys fees. Justice Department lawyers argued that Ashcroft and Mueller were not responsible for the conditions of his confinement or any alleged mistreatment.

WASHINGTON — A former Army journalist recalled to active duty this month refused to report to his new assignment Sunday night, citing his opposition to the Iraq war.
Matthis Chiroux, who served five years in the Army before separating last summer, said he expects and welcomes legal action resulting from his refusal, calling U.S. operations in Iraq an illegal occupation.
"I don’t feel like I’m doing anything illegal at all," he said. "We basically have no cause for military presence in Iraq.
"I’m making this decision because I believe my first loyalty is to the higher ideals of this country, which are being blatantly violated by our leaders."
Army officials said he faces charges of failure to report and desertion for the move, although no legal action has been taken yet.

Gaza's Hamas rulers on Tuesday said they have reached a long-awaited cease-fire with Israel meant to end months of Palestinian assaults on Israeli border towns and bruising Israeli retaliation.
The announcement came shortly after Egypt, which has been trying to broker the truce for months, said the cease-fire would go into effect on Thursday. Israel refused to confirm a deal, but said a "new reality" would take hold if Palestinian attacks end.
In a last-minute jolt, Israeli aircraft attacked three targets in the southern Gaza Strip. One of the airstrikes destroyed a car, killing six militants inside.
A large crowd gathered around the car's smoldering remains, and a puddle of blood was visible on the asphalt. Gaza militants then fired four mortar shells at Israel, the first of the day, the military said. No one was hurt.
Hamas officials accused Israel of trying to undermine the truce, but said they would not let the violence derail the Egyptian efforts.
"We are going to commit ourselves to the start time that Egypt is going to declare regarding the calm," said Hamas spokesman Sami Abu Zuhri. However, the group's television station said the movement would respond to "any Zionist aggression," underscoring the delicate situation.
Egypt's powerful intelligence chief, Omar Suleiman, has been meeting separately with Israeli and Hamas officials for months in hopes of brokering a truce.
Israel has been seeking a halt to rocket attacks launched from Gaza nearly every day, an end to Hamas' weapons buildup, and the release of an Israeli soldier held by Hamas for two years.
Hamas, meanwhile, wants an end to Israel's military activity in Gaza and the lifting of an Israeli blockade that has caused widespread destitution in the already impoverished coastal strip.
The state-run Egyptian news agency MENA cited an unidentified high-level Egyptian official as saying both sides "have agreed on the first phase" of an Egyptian-mediated package to end the violence in Gaza.
It said the first phase would be a "mutual and simultaneous calm" in the Gaza Strip beginning at 6 a.m. Thursday.
An Egyptian official told The Associated Press that if the area is quiet for three days, Israel would begin to open Gaza's border crossings to let more humanitarian supplies into the area. A week later, Israel would allow in additional goods.
The official said in a final phase Israel would consider reopening Gaza's border crossing with Egypt. The Rafah crossing is the main route for Gaza's 1.4 million people to leave the area. Israel and Egypt closed the crossing in June 2007 after Hamas violently seized control of Gaza, a move that has confined the vast majority of Gazans inside the coastal strip for the past year.
The deal is meant to last for six months, he said, and includes the possibility of extending a truce to the West Bank, where Israeli regularly conducts arrest raids targeting militants.

I'm having surgery July 11th for knee replacement. There is alot of physical therapy afterwards and the drs tell me 3 months but it may be less. Hopefully!

America may be discussing whether Barack Obama is tough enough to field a 3 a.m. phone call, but for the Chinese Communist Party's official newspaper, the real issue is his race.
"Obama's skin color is the biggest focal point of this year's U.S. election," said the opening line in a front-page editorial in the overseas edition of Monday's People's Daily newspaper.
The editorial, while perhaps stark in its analysis, gave voice to a fascination among many Chinese at the sight of a black man running for president in the world's most powerful nation. The U.S. campaign, and Obama's victory over Hillary Rodham Clinton, have provided them with a noticeable contrast to China's own situation, where Han Chinese eclipse minorities by their overwhelming majority and show no sign of relinquishing their hold on the levers of power.
The race issue has become particularly sensitive here in recent months, with the Public Security Bureau accusing Muslim Uighur separatists in the Xinjiang region of plotting terrorist attacks in Beijing, and Tibetans rioting against Han Chinese rule in Lhasa, the Tibetan regional capital, and several other Tibetan-inhabited areas.
The editorial sought to explain that Obama's breakthrough should not be understood as a demonstration that race relations have crossed a threshold in the United States that China has yet to approach. Obama, it said, became the Democratic Party's presumptive presidential nominee because, as a Harvard lawyer, he shares the same "background" as others in the U.S. elite.
"Obama won precisely because he did not emphasize his racial characteristics," the writer said. "He even made a clean break with radical black people. Therefore it can be said Obama won because of his skin color and not because of his skin color. His skin color made him different but his U.S. background made him the same.
"Obama is a graduate from a first-class university," the editorial continued. "He is a symbol of assimilation rather than a representative of different races coming together. Obama did not break the superiority complex of white people. On the contrary, his appearance strengthened the superiority complex of white people."
The editorial was signed by Ding Gang, a name frequently assigned to important analyses in a publication that plays the role of party bulletin board. Chinese journalists said they believe it is a pen name used by senior editors or other party propaganda officials conveying an official point of view.

Seventeen-year-old Jackie Mitchell, brought in to pitch in the first inning after the starting pitcher had given up a double and a single, faced Babe Ruth. After taking a ball, Ruth swung and missed at the next two pitches. Mitchell's fourth pitch to Ruth was a called third strike. Next up was Gehrig who swung through the first three pitches to strike out. Whenever a doctor offered me cortisone, I told him I'd rather die from my my ailment than from the cortisone's side effects.
The same goes for the anti-depressants. When one's depressed, it's best to learn/to be told it will run its course when the cause is addressed (and it can run its course if addressed, since depression is a response to GRIEF and grief can be healed). When one takes an anti-depressant for grief, one not only does not get over the grief, on top of it, one is burdened with drug dependence.
That Effexor sounds like Totalitarian Fascism's dream-come-true. No wonder they tested it for such a long time. A drug that one never gets off. A drug that masks the grief so thoroughly, one forgets one is/was grieving. Just the thing for a Brave New World where humans will grieve constantly for their loss of freedom, loss of social mobility, as they are denied civil rights and sane government and justice via rule of law and tenets like habeus corpus.

You can't get different genes, but how you act can change how your genes act, report Dean Ornish, MD, and colleagues at the University of California, San Francisco (UCSF).
Ornish is a clinical professor of medicine at UCSF and also a diet guru who's been telling us for years that by improving our lifestyle we can prevent and even reverse many chronic diseases. And Ornish has been putting his money where his mouth is, backing a number of scientific studies that support his arguments.
Now, in a new kind of study, Ornish is joined by UCSF professor and chairman of urology Peter Carroll, MD; UCSF prostate-cancer geneticist Christopher Haqq, MD, PhD; and others. The goal of this pilot study was to see whether the Ornish lifestyle could help 30 men with low-risk prostate cancer who chose not to undergo treatment unless their cancer got worse.
It's too soon to say whether the men's lifestyle changes kept their cancer at bay. But genetic analysis revealed profound differences in noncancerous prostate tissues in just three months.
More than 500 genes changed the way they worked. Genes with beneficial effects, including some tumor-suppression genes, became more active. Genes with deleterious effects, including some cancer-promoting genes, were switched off.
"It is absolutely intriguing this lifestyle change can have as much effect as the most powerful drugs available to us now," Haqq said in a news conference. "We medical oncologists are always looking for drugs that can do this. It is delightful to find that diet and lifestyle can have profound effects and work as well as drug therapies with fewer side effects."
Ornish says the findings may motivate people who think there's nothing they can do.

“Ten years ago I could never have imagined I’d be doing this,” says Greg Pal, 33, a former software executive, as he squints into the late afternoon Californian sun. “I mean, this is essentially agriculture, right? But the people I talk to – especially the ones coming out of business school – this is the one hot area everyone wants to get into.”
He means bugs. To be more precise: the genetic alteration of bugs – very, very small ones – so that when they feed on agricultural waste such as woodchips or wheat straw, they do something extraordinary. They excrete crude oil.
Unbelievably, this is not science fiction. Mr Pal holds up a small beaker of bug excretion that could, theoretically, be poured into the tank of the giant Lexus SUV next to us. Not that Mr Pal is willing to risk it just yet. He gives it a month before the first vehicle is filled up on what he calls “renewable petroleum”. After that, he grins, “it’s a brave new world”.
Mr Pal is a senior director of LS9, one of several companies in or near Silicon Valley that have spurned traditional high-tech activities such as software and networking and embarked instead on an extraordinary race to make $140-a-barrel oil (£70) from Saudi Arabia obsolete. “All of us here – everyone in this company and in this industry, are aware of the urgency,” Mr Pal says.

What is most remarkable about what they are doing is that instead of trying to reengineer the global economy – as is required, for example, for the use of hydrogen fuel – they are trying to make a product that is interchangeable with oil. The company claims that this “Oil 2.0” will not only be renewable but also carbon negative – meaning that the carbon it emits will be less than that sucked from the atmosphere by the raw materials from which it is made.

New US military contractor overbilling scandal in Iraq looms
WASHINGTON (AFP) — A civilian Pentagon official in charge of the largest US military contract in Iraq was removed from his job in 2004 after refusing to pay one billion dollars to KBR Inc. because the company was unable to credibly justify its expenses, the New York Times reported Tuesday.
KBR is an engineering, construction and services company that until April 2007 was a subsidiary of the Houston-based energy firm Halliburton, which was formerly led by Vice President Dick Cheney.
"They had a gigantic amount of costs they couldn't justify," the official, Charles Smith, told The New York Times. "Ultimately, the money that was going to KBR was money being taken away from the troops, and I wasn't going to do that."
According to Smith, the funds were released to KBR (formerly Kellogg Brown & Root), the main US company in charge of providing food and housing for US forces in Iraq.
The US army denied that Smith was removed because of the dispute, the newspaper reported.
Democratic Senator Hillary Clinton on Tuesday called for a congressional probe into contracts allocated by the US administration to KBR.

Phoenix Makes First Trench in Science Preserve

NASA's Phoenix Mars Lander began digging in an area called "Wonderland" early Tuesday, taking its first scoop of soil from a polygonal surface feature within the "national park" region that mission scientists have been preserving for science.
The lander's Robotic Arm created the new test trench called "Snow White" on June 17, the 22nd Martian day, or sol, after the Phoenix spacecraft landed on May 25. Newly planned science activities will resume no earlier than Sol 24 as engineers look into how the spacecraft is handling larger than expected amounts of data.
During Tuesday’s dig, the arm didn't reach the hard white material, possibly ice, that Phoenix exposed previously in the first trench it dug into the Martian soil.
That's just what scientists both expected and wanted. The Snow White trench is near the center of a relatively flat hummock, or polygon, named "Cheshire Cat," where scientists predict there will be more soil layers or thicker soil above possible white material.
The Snow White trench is about two centimeters deep (about three-quarters of an inch) and 30 centimeters (about a foot) long. The Phoenix team plans at least one more day of digging deeper into the Snow White trench.
They will study soil structure in the Snow White trench to decide at what depths they will collect samples from a future trench planned for the center of the polygon.
Meanwhile, the Thermal and Evolved-Gas Analyzer (TEGA) instrument continues its ongoing experiment in the first of its eight ovens.
TEGA has eight separate tiny ovens to bake and sniff the soil to look for volatile ingredients, such as water. The baking is performed at three different temperature ranges.
The Phoenix mission is led by Peter Smith of the University of Arizona with project management at JPL and development partnership at Lockheed Martin, located in Denver. International contributions come from the Canadian Space Agency; the University of Neuchatel, Switzerland; the universities of Copenhagen and Aarhus, Denmark; Max Planck Institute, Germany; and the Finnish Meteorological Institute. Baghdad insists on right to veto US operations
Iraq is insisting on the right to veto any US military operations throughout its territory under a "status of forces" agreement currently being negotiated between Baghdad and Washington, according to a senior member of the Iraqi government.
The agreement will last for a maximum of two years and can be terminated by either side with six months' notice, Hussain al-Shahristani, Iraq's oil minister, told the Guardian yesterday.
His remarks come amid intensive closed-door negotiations between the Iraqi and US governments which have led to complaints in the US Congress as well as Iraq that the Bush administration is tying the next US president's hands by seeking to maintain long-term bases in Iraq for possible attacks on Iran and other neighbouring states.
But Shahristani insisted yesterday: "Neither the constitution nor our people will allow any violation of our sovereignty. Obviously foreign troops on Iraqi soil carrying out operations without the prior consent and approval of the elected government is a violation.
"Any arrests, any operations internally or externally against our neighbours without prior agreement of the Iraqi government will be considered a violation ... Land and sea movements and air space is all part of Iraq's sovereignty."
