DOJ wins a legal battle with DNC over White House e-mails

A federal judge has handed the White House a legal victory in a battle with the Democratic National Committee over e-mails related to U.S. attorney firings.

District Judge Ellen Huvelle of the U.S. District Court for the District of Columbia ruled Thursday that the DNC does not have a right under the Freedom of Information Act to 68 pages of e-mails sent between White House and Justice Department officials simply because the White House e-mail traffic was transmitted on a server controlled by the Republican National Committee.

The DNC sued the Justice Department in April 2007 after its FOIA request for the e-mails, which relate to the firing of nine U.S. attorneys, was not granted by DOJ. Attorneys for the DNC argued that since the White House officials used "GWB43.com" e-mail addresses to send the messages, they cannot be deemed to be official in nature and therefore must be turned over under the DNC's FOIA request. Eighty-eight White House officials were given those RNC-controlled addresses to conduct political activities, but the Bush administration later claimed that the accounts were used to handle other official business, such as interactions between the White House and senior DOJ aides on the prosecutor purge.

In dismissing the DNC lawsuit, Huvelle ruled that it was "based on the false factual premise that White House officials only used their RNC e-mail accounts for political communications."

Additionally, Huvelle decided that just because an RNC server was used to send the messages — 68 pages out of more than 5,000 which have been denied to the DNC — it is not enough to automatically disqualify the Justice Department from claiming a FOIA exemption in refusing to release them.

Is Al Gore the Answer?

Unlike Barack Obama, Bill Clinton does not believe in "the fierce urgency of now." The former President has an exquisitely languid sense of how political time unfurls. He understands that those moments the political community, especially the media, considers urgent usually aren't. He has seen his own election and reelection - and completing his second term - pronounced "impossible" and lived to tell the tale. He remembers that in spring 1992 he had pretty much won the Democratic nomination but was considered a dead man walking, running third behind Bush the Elder and Ross Perot. He knows that April is the silly season in presidential politics, the moment when candidates involved in a bruising primary battle seem weakest and bloodied, as both Hillary Clinton and Obama do now. It's the moment when pundits demand action - "Drop out, Hillary!" - and propound foolish theories. And so I'm rather embarrassed to admit that I'm slouching toward, well, a theory: if this race continues to slide downhill, the answer to the Democratic Party's dilemma may turn out to be Al Gore.

This April promises to be crueler than most. The two campaigns have started attacking each other with chainsaws, while the Republican John McCain is moving ahead in some national polls. At this point, Clinton can only win the nomination ugly: by superdelegates abandoning Obama and turning to her, in droves - not impossible, but not very likely either. Even if Clinton did overtake Obama, it would be very difficult for her to win the presidency: African Americans would never forgive her for "stealing" the nomination. They would simply stay home in November, as would the Obamista youth. (Although the former President is probably thinking: Yeah, but John McCain is a flagrantly flawed candidate too - I'd accept even a corrupted nomination and take my chances.)

Which is not to say that Clinton's candidacy is entirely without purpose now that she is pursuing a Republican-style race gambit, questioning Obama's 20-year relationship with the Rev. Jeremiah "God damn America" Wright. Democrats will soon learn how damaging that relationship might be in a general election. They'll also see if Obama has the gumption to bounce back, work hard - not just arena rallies for college kids but roundtables for the grizzled and unemployed in American Legion halls - and change the minds that have turned against him. The main reason superdelegates have not yet rallied round Obama is that the party is collectively holding its breath, waiting to see how he performs in Pennsylvania, North Carolina and Indiana.

He will probably do well enough to secure the nomination. But what if he tanks? What if he can't buy a white working-class vote? What if he loses all three states badly and continues to lose after that? I'd guess that the Democratic Party would still give him the nomination rather than turn to Clinton. But no one would be very happy - and a year that should have been an easy Democratic victory, given the state of the economy and the unpopularity of the incumbent, might slip away.

Which brings us back to Al Gore. Pish-tosh, you say, and you're probably right. But let's play a little. Let's say the elders of the Democratic Party decide, when the primaries end, that neither Obama nor Clinton is viable. Let's also assume - and this may be a real stretch - that such elders are strong and smart enough to act. All they'd have to do would be to convince a significant fraction of their superdelegate friends, maybe fewer than 100, to announce that they were taking a pass on the first ballot at the Denver convention, which would deny the 2,025 votes necessary to Obama or Clinton. What if they then approached Gore and asked him to be the nominee, for the good of the party - and suggested that he take Obama as his running mate? Of course, Obama would have to be a party to the deal and bring his 1,900 or so delegates along.

I played out that scenario with about a dozen prominent Democrats recently, from various sectors of the party, including both Obama and Clinton partisans. Most said it was extremely unlikely ... and a pretty interesting idea. A prominent fund raiser told me, "Gore-Obama is the ticket a lot of people wanted in the first place." A congressional Democrat told me, "This could be our way out of a mess." Others suggested Gore was painfully aware of his limitations as a candidate. "I don't know that he'd be interested, even if you handed it to him," said a Gore friend. Chances are, no one will hand it to him. The Democratic Party would have to be monumentally desperate come June. And yet ... is this scenario any more preposterous than the one that gave John McCain the Republican nomination? Yes, it's silly season. But this has been an exceptionally "silly" year. View this article on Time.com

Everyone may be arguing about who signed what affidavit and who voted for whom in ohio but you may need to look deeper into the laws to find true wrongdoing. This time, it would include texas and pennsylvania and any person in any state. Under section 2385 of the treason laws they spell out that it does not only cover the US government or just the state government when trying to overthrow the government. It doesn't just end with the government...

"Whoever knowingly or willfully advocates, abets, advises, or teaches the duty, necessity, desirability, or propriety of overthrowing or destroying the government of the United States or the government of any State, Territory, District or Possession thereof, or the government of any political subdivision therein"

When the treason law states "ANY POLITICAL SUBDIVISION THEREIN" it does not state anything geographical. A political subdivision would be considered a political party and thereby mean that those who crossed party lines to wreak havoc with the democratic party may be described as committing treason against a part of the United States. That's not just Ohio, people - that's everywhere including the upcoming pennsylvania race.

Subverting the government is an attempt to overthrow by not allowing the true will of the people to decide.

Everyone who has participated or will participate should be tried and if found guilty, get the appropriate punishment which is, "shall be fined under this title or imprisoned not more than twenty years, or both, and shall be ineligible for employment by the United States or any department or agency thereof, for the five years next following his conviction."

As far as the fat boy Rush "oxycontin" Limbaugh is concerned you need not look any further than the first line of this treason law... "Whoever knowingly or willfully advocates, abets, advises, or teaches..." Yes, the fat boy, Rush "little Dominican girl" Limbaugh, has indeed committed treason!

On Lionel's old show some of his regular callers were very conservative New York police officers. They often spewed a lot of racism. Lionel was just peachy with that. Lionel was no friend of Air America in those days. He mocked Progressive Talk. He absolutely detest being called liberal.

I have posted comments he made about Rachel Maddow. He has expressed a profound hatred of the Kennedy's as well. He is quite a chauvinist.

Mark Green picked him over Sam. I wonder why?

Charlie Black currently works for Mark Penn. But that's about to change. Black is choosing McCain over Penn:
Top Washington lobbyist Charlie Black is leaving his firm to join Sen. John McCain’s (R-Ariz.) presidential campaign.

Black, chairman of BKSH & Associates, told The Hill his resignation would be effective Monday, March 31. He will join McCain's campaign on a full-time basis starting Tuesday.

Now if we could only get Penn to choose Obama over McCain.

Can't Stand The Lionel Show

So I just complained to AAR over "The Lionel Show", the host half heartedly endorsed Ron Paul the other day. I don't know if it was supposed to be a joke, but he said words the effect of..."I don't know who I would support but I guess if it had to be someone it would be Ron Paul". I thought AAR was a liberal radio network, not a Libertarian one. He also gets off topic often, spends way too much time on gossip, and I generally don't find him funny. Maybe its because I am a female under 40 years old but I don't get his humor.

I loved your show when it was in the same time slot. I realize that the 9-12 Time slot has been a trouble spot for AAR, due to the constant changes to the schedule, but I gotta say I loved your show. Now I have to listen to you if I use my premium membership because I am usually working on Sundays.

I wish they would wise up and give you a bigger show again!

It's been another raucous week on the campaign trail. We'll have to wean ourselves from the national polls and start focusing on the key state polls, Pennsylvania, North Carolina and Indiana. Clinton is way up in PA and should win that state by 15-20 points. That means North Carolina and Indiana are going to be pivotal.

New Bush admin. scandal: Top aide quits over misuse of US AID money

The White House says an aide to President Bush has resigned because of the alleged misuse of grant money from U.S. Agency for International Development.

Presidential spokesman Scott Stanzel says the former aide, Felipe Sixto, had been a special assistant to the president for intergovernmental affairs. Stanzel said Sixto was promoted to that position on March 1 and that he came forward on March 20 to tell his superiors about the alleged wrongdoing.

Stanzel said it involved improprieties involving the use of grant money and Sixto's former employer, the Center for a Free Cuba. Stanzel says the matter has been turned over to the Justice Department.

But remember, they love the free market. That's what Wall Street and the GOP tell us anyway. Just make sure the "free" is free money from taxpayers. What a sad bunch of freeloaders. The only thing that's worse is that nobody is getting serious yet about the strings that ought to be attached. If we're going to subsidize these bums then what are we getting in return? Another CEO making millions in stock sale profits? Sorry, not interesting.

What is so difficult about talking money now, as in today? Give me specifics about the new regulations that will safeguard our investments. Tell me how we're going offer plans to help investors from getting ripped off by Wall Street charges on their retirement plans. Maybe even put a hold on executives from selling any of their shares until we have a clear picture of what is happening. These are extraordinary times so let's not miss the window. Let's talk about this now. Today. Not tomorrow. Today.

The Navy lawyer for Osama bin Laden's driver has accused senior Pentagon officials of orchestrating war crimes prosecutions of detainees held at Guantanamo Bay, Cuba, to influence the outcome of the 2008 presidential campaign.

In a brief filed Thursday, Navy Lt. Cmdr. Brian Mizer describes a Sept. 29, 2006, meeting at the Pentagon in which Deputy Defense Secretary Gordon England, a veteran White House appointee, asked lawyers to consider Sept. 11, 2001, prosecutions in light of the campaign.

''We need to think about charging some of the high-value detainees because there could be strategic political value to charging some of these detainees before the election,'' England is quoted as saying. Former chief Guantanamo prosecutor, Air Force Col. Morris Davis, recounted the England remark after he resigned, claiming political interference.
