FORMER BOARD OF ELECTIONS DEPUTY DIRECTOR PLEADS GUILTY

Former Franklin County Board of Elections (Board) Deputy Director Michael Hackett plead guilty today to three Ethics charges in Franklin County Municipal Court from profiting from Board of Elections’ contracts for voting machines. Judge Ann Taylor sentenced Hackett to 180 days in jail on the three criminal offenses. Judge Taylor suspended the jail time, placing Hackett on a year’s probation, and under conditions that he perform 45 hours of community service, make $2500 restitution to Franklin County on behalf of the Board, and pay a total of $750 in fines, plus court costs. Hackett told the court that he was “very sorry” for his misconduct.

Brunner's New Directive Also Requires Such Ballots Actually Be Counted Before Unofficial Results are Released to the Public, Media
Concerns Remain About Centralized County Tabulation, However...
Ohio Secretary of State Jennifer Brunner issued a short, unambiguous and to-the-point directive [PDF] last night, to all 56 counties in Ohio still employing unverifiable Direct Recording Electronic (DRE, usually touch-screen) voting machines, that they must make a paper ballot available at the polling place to any voter who wishes to vote on one.

Brava!

Her directive even goes so far as to require those paper ballots actually be counted "on election night as part of the unofficial canvass."

Brava again! The requirement to actually count those paper ballots before unofficial results are release to the public and media is a key component that has been missing from the various federal legislative efforts, including Rep. Rush Holt's (D-NJ) latest bill as currently drafted, as well as his previous one (HR811), that would begin to put paper back into the polling place.

Every state in the country should follow suit! As well, we recommend that, at the very least, Brunner issue a further directive that signs shall be conspicuously and clearly posted in each polling place to inform voters of their right to vote on paper, if they wish. Better still, a directive that requires every voter to be asked by voting officials, before they vote, if they wish to vote on paper. We have previously recommended such a "paper or plastic?" requirement for any jurisdiction in America that still allows for the use of horrible DRE systems (including those with or without a useless, so-called "paper trail").

Until then, Democracy advocates in the Buckeye state will need to launch an important, and potentially expensive (but crucial), education campaign to inform voters of their right to vote on paper!

Our torturous vice president. Yesterday, Attorney General Mike Mukasey announced a DoJ probe into the CIA’s torture tape destruction. The Washington Post’s Dan Froomkin raises the question of whether the probe will investigate the roles of Vice President Dick Cheney and his chief of staff, David Addington:

Cheney has been the administration’s central figure on all things related to torture. […]

So it should have come as no surprise when the New York Times reported last month that David S. Addington, Cheney’s chief of staff and former legal counsel, was among the three White House lawyers who participated in at least one key meeting about the videotapes in 2004.

The initial spin from the White House was that only Harriet E. Miers, then a deputy White House chief of staff, had been briefed about the tapes — and that she had advised against their destruction.

But with anything related to torture, it’s pretty clear the CIA took its orders from Cheney — via Addington. And how plausible is it that, in his exchanges with the CIA, Addington advised against the tapes’ destruction? Or that the CIA would have done it if he had told them not to? Isn’t it more likely that he supported the idea, either overtly or with a nod and a wink?

Dear ,
I am sorry that this is distressing you, but the solution is very simple: just re-register, this time checking "Peace and Freedom Party," and you will be able to vote in our primary. You should do so promptly, as the deadline is around the middle of January. Sending in a postcard form right now would do it.

Most parties in California do not permit people to vote in their primaries who are not registered to vote in that particular party. (Until recently that was always the rule for all parties.) Many other states have different rules, and in some those who register "independent" may simply pick a party to vote in on the day of the primary. That has never been the case in California. So some people from other states have been very upset to find that they were unable to pick a party on primary election day.

Because there are big advantages to maintaining our number of registered voters (for example, maintaining our ballot status), it is unlikely that our State Central Committee would decide to open up our primary ballot to people who are not registered in our party. Most smaller parties have the same concern. They fear two things: losing registrants, and ballot status, if people can register "decline to state" and yet vote in their primaries; and opening themselves up to campaigns directed at giving their nominations for some offices to people who sharply disagree with their parties. This is not a vague and baseless fear, but an actual description of what has happened to some smaller parties in other states.

We have had considerable success in convincing people outside our party to vote for our candidates in general elections, in some cases getting over 20% of the vote when our actual registration in the district is below 1% of the voters. We believe we will be able to get more votes soon, and hope to win some partisan elections. (Members of our party have been winning some non-partisan elections all along, for local office. For example, my late father was elected to the Keeler Community Services Board while also serving as Inyo County Chair of the Peace and Freedom Party.

There is really no good reason in California to register "decline to state," except perhaps for members of the Bahai'i faith, who may vote in general elections but are forbidden by their religious rules from helping select the candidates of a party in primaries. The rest of us, if we register in no party at all, are simply giving up the chance to help select any candidates for partisan office in primaries.

Some people pick their party anew before each primary election, depending on which candidates they want to support. So, for example, if you want to vote in the Peace and Freedom Party primary for President, you would register in our party now, and if you want to help select the candidates of another party for Congress or the state legislature in June, you could re-register in that party by mid-May.

I would suggest that if you want to vote for any of our Presidential candidates in February, you are probably in substantial agreement with most of our party's positions on major issues, and should just stay registered in the Peace and Freedom Party and help select our partisan candidates in each primary. Of course, in the general election in November, you may vote for anyone you please of any party for all offices, no matter how you are registered.

I quite agree that receiving no response to your previous calls and e-mails is unacceptable. Could you let me know which number you called, and what e-mail address(es) you used? I would like to follow up on that, and see what happened.

It would seem logical that if one "declines to state" a party that that would mean that person could vote for ANY candidate.. And in some states they CAN do that. But not in CA.

Folks get together in a room and tell others which candidate they support and why.

People talk, debate, and switch their support for other candidates (when their candidate is eliminated during the process and/or they decide to support another candidate).

Yes, a person's second choice is extremely important during the process.
