In a written response to questions from Senate Democrats today, Attorney General nominee Michael Mukasey refused to explicitly say whether he believed waterboarding to be torture. In the four-page letter, Mukasey called the interrogation technique “over the line” and “repugnant” on “a personal basis,” but added that he would need the “actual facts and circumstances” to strike a “legal opinion”:

Hypotheticals are different from real life and in any legal opinion the actual facts and circumstances are critical.

CNN’s Ed Henry notes that with his “facts and circumstances” hedge, “essentially Michael Mukasey is dodging the question of whether legally waterboarding is torture.” Watch Henry’s report:

Senate Democrats have said that Mukasey’s answer on the question of waterboarding and torture is crucial to their vote on his confirmation. “It’s fair to say my vote would depend on him answering that question,” Judiciary Committee Chairman Patrick Leahy (D-VT) told reporters last week. Sen. Dick Durbin (D-IL) called it “the seminal issue.”

Sen. Lindsey Graham (R-SC), a judge advocate general in the military, has said that it shouldn’t be difficult for Mukasey to be clear on the issue:

If he does not believe that waterboarding is illegal, then that would really put doubts in my own mind because I don’t think you have to have a lot of knowledge about the law to understand this technique violates” the Geneva Convention and other statutes.

Time reported earlier today that if Mukasey “refuses to declare waterboarding expressly illegal, he looks likely to be rejected by the Judiciary Committee.”

Suspicious crew raises alarm and a flight is canceled

SAN DIEGO – The takeoff of an American Airlines flight out of Lindbergh Field was canceled in August because the crew was suspicious of several Middle Eastern passengers, an investigative report said. The crew notified the captain, who canceled the flight.

At the time, the airline said it was a woman traveling with her two small children who raised the alarm.

According to the airline's account of the incident, the woman said the men made her so nervous she asked to be let off the plane, and the ensuing delay pushed the Aug. 28 flight to Chicago past the 11:30 p.m. curfew on takeoffs.

American Airlines spokesman Tim Wagner referred to it as a “customer dispute.”

But a report from the San Diego Harbor Police, which was released this week under the California Public Records Act, said members of the flight crew said they were nervous about a group of the Middle Eastern passengers and did not feel safe.

One flight attendant told investigators the behavior of the group made him nervous and was “making his hair stand on end.”

He said that one of the men went into the bathroom and when he came out he stood next to a woman and stared at her for three to four minutes. That passenger got off the plane.

The flight attendant also said that another man in the group began to stare at him in an “abnormal, unusual and intense” way. When he mentioned that to the other attendants, they each said they felt they were being stared at in the same fashion.

“It was like each of these (Arabic) passengers had their assigned attendant,” Kotsonis said.

Another flight attendant told investigators he had “a gut feeling and discomfort” and “needed to do something” after one of the men put a blanket on his head during the safety demonstration only to take it off and stare angrily at everyone around him.

After the passenger got off the plane, the crew talked among themselves and decided to notify the pilot about their concerns.

It turned out that the group of seven Iraqi and Iraqi-American men worked for an Alaska-based defense contractor and had been training U.S. Marines at Camp Pendleton. They have hired a lawyer.

Two thoughts, related, came immediately to mind and I suspect that they came immediately to minds other than mine:

1.) It behooves a hijacker to blend in. Not blending in would seem to be a violation of Rule #1 for anyone who wants to evade discovery.

2.) Acting in a suspicious manner whilst on an airplane (especially for people of the swarthy persuasion) would seem to be the same as begging to be ejected. Not blending in would seem to be a violation of Rule #1 for anyone who wants to travel to his/her destination without incident.

GAO: Reduction In Violence Due To ‘Ethnically Cleansed Neighborhoods’ In Iraq
Looking for signs of progress in Iraq, the Bush administration has been quick to jump on reports of reduced violence in Iraq. The “violence is thankfully coming down,” said White House spokesperson Dana Perino. Violence is “down significantly from last year,” declared President Bush.

In a hearing before the House Appropriations Committee today, Joe Christoff of the Government Accountability Office stated that this recent reduction in violence should be taken with a grain of salt, as it coincides with increased sectarian cleansing and a massive refugee displacement:

I think that’s [ethnic cleansing] an important consideration in even assessing the overall security situation in Iraq. You know, we look at the attack data going down, but it’s not taking into consideration that there might be fewer attacks because you have ethnically cleansed neighborhoods, particularly in the Baghdad area. […]

It’s produced 2.2. million refugees that have left, it’s produced two million internally displaced persons within the countryas well.

Christoff’s conclusions echo that of ret. Gen. James Jones last month, who observed “progress” in a Shi’a-led ethnic cleansing campaign.

Also in attendance at the hearing was Special Inspector General for Iraq Reconstruction (SIGIR) Stuart Bowen. In his quarterly report to Congress released today, Bowen acknowledged the reduction in violence but stated that it has not been accompanied by tangible political reconciliation, a finding that was neglected by the traditional media in its reporting today. In Baghdad, for example, Provincial Reconstruction Team officials note:

Despite reduced violence, officials are pessimistic that lasting reconciliation is occurring. … In Diyala, there is a desire to work toward reconciliation, but it will take years to overcome ill-will between tribes.

Earlier this month, Gen. David Petraeus confidently declared, “There’s a local reconciliation” in Diyala province.

A new Zogby poll out today shows that 52% of likely voters would support a strike against Iran to prevent them from building nuclear weapons. Another 53% believe it "likely" that such an attack will take place before the next election:

Democrats (63%) are most likely to believe a U.S. military strike against Iran could take place in the relatively near future, but independents (51%) and Republicans (44%) are less likely to agree. Republicans, however, are much more likely to be supportive of a strike (71%), than Democrats (41%) or independents (44%). Younger likely voters are more likely than those who are older to say a strike is likely to happen before the election and women (58%) are more likely than men (48%) to say the same – but there is little difference in support for a U.S. strike against Iran among these groups.

About one of every eight veterans under the age of 65 is uninsured, a finding that contradicts the assumption many have that all vets qualify for free health care through the Veterans Affairs Department, says a new study.

Researchers at Harvard Medical School projected that about 1.8 million veterans overall lack health coverage. That's an increase of 290,000 since 2000. The researchers said most uninsured veterans are in the middle class and are ineligible for VA care because of their incomes. Still others cannot afford their copayments, or lack VA facilities in their community.

"Like other uninsured Americans, most uninsured vets are working people — too poor to afford private coverage but not poor enough to qualify for Medicaid or means-tested VA care," said Dr. Steffie Woolhandler, an associate professor and a physician at the Cambridge Health Alliance.

The study is based on an analysis of government surveys released between 1988 and 2005. Veterans do fare better than the overall population when it comes to obtaining health insurance. Still, the Harvard researchers said the rising number of uninsured vets points to the need for more funding for the VA. The best solution, they said, would be for universal health coverage in the United States.

"Only the government can put men and women into military service and only the government can guarantee that they are covered after they serve," said Dr. Jeffrey Scavron.

You must be seeing a narrow definition of "deal with" that I don't see? The poll question obviously excludes the "war only" definition. If "China" were substituted for "Iran" in the question and the poll results were the same, would you draw the same "Hillary is a hawk" conclusion?

With all the hoops one must go through to even get on the plane, any chance the crew could do their jobs. I would imagine that the passengers were staring back at the crew members who were staring at them. For just having a feeling, perhaps the crew could call it in to double check security if they were apprehensive, but how about going up and conversing with the passengers, and showing some empathy. Like..." you appear a little nervous, are you afraid of flying?" "Is there something I can do or get to make you more comfortable?"

Sometimes fear just needs to faced down to be eleviated. And I imagine these passengers are confronted with this type of behavior constantly particularly with the current adminstration's drone of "be afraid, be very afraid."

The incident as reported seems very odd to me as I tried to convey by writing my knee-jerk reaction to anyone crazy enough to act weird on an airplane.

At the bottom of Kevin's post and in bold type is this: "It turned out that the group of seven Iraqi and Iraqi-American men worked for an Alaska-based defense contractor and had been training U.S. Marines at Camp Pendleton..."

I'm uncertain if this is supposed to indicate that the men on the airplane were regular joes being unfairly judged, or what? My inclination is to suspect the opposite. Men who are deeply and continuously immersed in the warrior culture can have rusty (or severely corroded) social skills.

I'm uncertain if this is supposed to indicate that the men on the airplane were regular joes being unfairly judged, or what? My inclination is to suspect the opposite. Men who are deeply and continuously immersed in the warrior culture can have rusty (or severely corroded) social skills.

...maybe they could have better gauged the situation or disengaged it by "congeniality." Maybe they would have learned they had helped the marines.

The bottom of the post was not lost on me. I being a tall, rather attractive (so I've been told) female raised with three brothers can recognize machismo was at play here and is not exclusive to any one ethnicity or culture.

I, as liberal, happen to actually believe in giving "peace a chance" using available attributes/skills to positively diffuse the situation and so not to demean anyone involved. With that being said, make no mistake, my line is drawn at abusive and threatening behavior, and I can be just as tough with that reality too. The actions described would not have scared me enough not to at least try "congeniality" while others were taking some other precautions.

I am not living in la-la land but I am not, and not going to, live in fear either. Just saying.

A Bad Day For Math

Today has been one of those days when my brain keeps popping out of gear. My head feels heavy and dull, like a trucker's tarpaulin is between me and my nearest synapse. Ordinarily I am agile but I have dropped or knocked over three items today, one of which broke.

I haven't been drinking or drugging. I feel fine other than being stupefied.

I wonder what happens to a brain on days like this? Is it preoccupied with something that it's not telling me about? We shouldn't be keeping secrets from one another, should we? Is this a scheduled maintenance day? Was everything moved outside before the cranium repainting began?

I hope I can make it to bedtime without stubbing my toe on an immovable object. Or ordering a George Foreman Grill.

I’m not one who actually thinks that presidential health is all that important, and certainly don’t think that such illness/treatment should in any way be a disqualifier.

I’m actually going to disagree here. While I appreciate the restraint of those who haven’t gone through the experience, as someone who just got out of a four month round of chemotherapy I do think there are serious questions that need to be asked about this. And I’d be saying the exact same thing about a Democratic candidate.

It’s one thing for a potential nominee’s family to be in chemotherapy (Elizabeth Edwards) but it’s quite another for the candidate himself. During chemo we joked that about 50% of my IQ had been shaved off, and I’d say that was a pretty realistic assessment. I couldn’t remember anything from one moment to another, had no ability to read an average-length newspaper article and recall what it said at the beginning by the time I got to the end. It also made me really emotional and affected my judgment. It was important for me for a variety of reasons to keep blogging but I could not have done the kind of detail-oriented, in-depth kind of stuff I used to do during the days of Plame any more than I could fly. My posts got short and I had to check them with people before I put them up to make sure I hadn’t made some big mistake and left out something huge. I’m only now starting to get my brain back and my concentration is still poor eight months after I started chemo.

People in cancer treatment want to live their lives to the fullest, and there’s no reason for anyone to question Elizabeth Edwards’ qualifications as a mother for supporting her husband during treatment except for sexist claptrap. But that doesn’t mean you’re qualified to do anything in the midst of it. The fact is that nobody is asking Fred Thompson about a condition that could very seriously impair his ability to run the country. And I think there are several good questions that Fred needs to answer:

Did your doctors call your cancer stage 4?
Your doctors already acknowledged your cancer is likely to return, do you think it’s fair to the American people to enter the White House knowing you will need more chemotherapy?
When was the last time you had chemotherapy?
While I understand that people’s experience with chemo brain may vary, it’s a very real phenomeon and its effects can linger 10 years after treatment. And if the job of the press is to help the public make informed decisions and not just fawn over candidates who clearly have some cognitive issues to begin with, they really need to hop to it.

Following the construction of four new branches, a total renovation of the main library, and improvements at 23 other libraries; well, circulation jumped 83%.

Nancy Nord, the agency's acting head, has been under fire in Congress for opposing Democrats' legislation to expand her agency's budget and work.

"Any commission chair who does not, in the face of the facts that are so clear, say we don't need any more authority or any more resources to do our job, does not understand the gravity of the situation," said Pelosi, who has been joined in her call for Nord's resignation by other Democrats in the House and Senate. "I call on the president of the United States to ask for the resignation."

Nord, in an Oct. 24 letter to the Senate Commerce Committee, said a Democratic bill that would expand her agency "could have the unintended consequence of hampering, rather than furthering, consumer product safety."

In earlier hearings in front of Congress, Nord had asked for additional funds for her agency.

Yeah. I found Trollope whilst searching for alternative spellings of trollop, then I used a variant in my post [Spelling variations of this family name include Trollop, Trollope, Trollupe, Trollup, Trolloop and others.].

I still think that trollop was the original word that Anonymous intended to write which was misspelled as Trollup and then it got messy from there. The sentence made little sense: "All Class Trollup." All class? Low class would have been more appropriate.

The "three wolves" etymology of Trollope is interesting but I don't think that it has any relationship with the etymology of trollop.

This doesn't just apply to anons...

I think it applies to anyone who doesn't use their real name online and is mean to others.

MSNBC took a break...so we'll start a new thread. This is really a debate. And, in fact, Hillary Clinton is being attacked. Her vote on the Kyl-Lieberman Iran resolution (written by neocons according to John Edwards) has given her opponents the fodder. And, it's not just coming from Edwards and Obama, but Dodd and Biden have been very strong, too.

At this point, I'd say Edwards is having a good night.

9:42 PM: The question is electability. Brian Williams quoted Rudy to challenge Hillary. She uses the GOP "obsession" with her as proof of her electability. Russert followed up on her experience question wanting her to allow the National Archives to release her records from the Bill Clinton years. Apparently, Bill Clinton wrote to the archives asking them to not release any correspondence between Bill and Hillary. She actually did not answer the question that she would allow it. Somehow, it's not her responsibility. Obama went right after her on that one. He also said the GOP is obsessed with Hillary because that's a fight they've had and want again.

Edwards also said the Republicans want to run against Clinton. He also turned it into a question on the influence of money in politics...and how Clinton represents the status quo. He represents change.

9:51 PM: Brian Williams asks Obama the experience question. Obama knows how to get things done, he says. He will also stand up to special interests. And, he reminds us that he stood against the war in 2002. We need principled leadership and that's what he'll give us.

9:53 PM: Richardson is hearing a holier than thou attitude towards Hillary Clinton, which he thinks is getting personal. We need to be positive he says -- as Richardson tells us he trusts her, but doesn't agree with her on a whole litany of issues. That sanctimonious thing doesn't really work.

9:56 PM: Dodd -- we need to elect a Democrat...a Democrat that's electable. Hmmm.

9:57 PM: Edwards lets us know he's not pure...none of them are, but disputes Richardson's assertion that the attacks are personal.

9:59 PM: Biden isn't running against Hillary Clinton, he's running to be the leader of the free world. Biden smacks Rudy Giuliani hard. Rudy is genuinely not qualified to be President. Every sentence Rudy speaks has a noun, a verb and 9/11. Good line.

10:02 PM: Russert starts a new subject -- Social Security. Wants to know if Hillary has different positions on lifting the cap intimating she answers one way publicly and another privately. She, of course, disputes that contention and gets into the good work done in the 90s. She's going to appoint a bi-partisan commission. She does not advocate raising the cap. Acting like Social Security is in crisis is a GOP talking point according to Hillary.

In the first questions posed to Obama and Edwards, they were given the chance to attack Clinton. Edwards did a much, much better job of defining his differences with Hillary. She was obviously prepared for the attack. Edwards focused on Iran, which Hillary did not address. She has a lot of "specific plans."

9:09 PM: Because Hillary didn't address Iran, Russert asked her why she voted for Kyl-Lieberman's resolution. She prefers "vigorous diplomacy." (But isn't that what she said she voted for in 2002 on the Iraq resolution.)

Russert followed up on Iran with Dodd who said this issue is going to come back to haunt us and what we didn't learn in '02, we should have learned now. OUCH. He's right, of course.

Biden, on the Iran vote, said there are consequences for what we do. (Biden and Dodd voted against Kyl-Lieberman.) Biden said the vote emboldened Bush.

9:15 PM: Continuing on Iran, Obama responds on Iran and when he would go to war what Brian William calls "the red line"...a question Obama rejected noting the "drumbeat of war" is coming from the GOP debates.

Hillary Clinton also got asked the "red line" question. She sounds very, very defensive on the Iran question. That Kyl-Lieberman vote undermines much of what she's saying. She "wants to start diplomacy." (Again, we've heard that before from her.)

9:19 PM: Edwards said Kyl-Lieberman sounds like it was written by the neocons. Noting some of us learned from our mistakes on Iraq, you give Bush an inch, he takes a mile. That resolution enabled Bush and let him "march forward." He asks how is that Democrats standing up to Bush?

:25 PM: Russert asks them all if they can pledge that Iran will not get a nuclear bomb when they are President. Obama gave a great answer on how Americans have been governed by the politics of fear -- sounding very much like Paul Krugman's excellent column yesterday, btw.) Both Biden and Dodd refocused the question and said that Pakistan poses a much bigger problem -- and both of them sound very, very competent on this issue. Kucinich took an appropriate swipe at the media -- telling them not to promote another war, which the media did in 2002. Very good point about not ratcheting up the rhetoric for war.

This vote was the vote to give Bush some Leeway about IRAN not Iraq.
Biden and Dodd did not vote for that. Obama wasn't there for the vote.Hillary did vote for it. So they put her in a corner about it. She was saying that the bill did not give Bush the power to attack Iran. But we all know how Bush does what he wants.

You are right on, Bush does not need any coaxing to ignore the law in order for his administration to do what it wants, and clearly no one has thrown up any obstacles to even slow him down.

The legislation that led to Bush's invasion of Iraq was not an authorization to do so, yet he used it for his purposes. It is my understanding Hilary unapologetically admitted to supporting it. And after seeing how that legislation was used and abused, yet again, she votes for similar legislation for his administration to construe for its purposes.

Hilary voting for this bill shows either she is not a quick study (not likely,) or that she is complicit (could be corroborated.)

It may be the very chink in the campaign to bring her down especially if Bush does attack Iran. And the other candidates would do well to work it if the elections are not cancelled in that event.

After today's admonishment by Bush, Congress should go into legislative shutdown and full oversight. It's obvious the peoples' business will not be done as long as this administration is in place. Better not to give him any opening or support to cause harm here or around the world.

Then I dropped something and it broke. Then I stared down at the pieces while a picture of a broom lingered unseen in the thought balloon over my head.

if this really happened to you these are fairly typical symptoms
of some serious medical/health issues
1)low blood sugar (very low)
2)TIA or even small stroke

it has been reported that many patients suffering debilitating strokes have had several small TIA's, days or weeks, prior to the stroke.
Crank Bait -this could be serious or it could be you needed your daily dose of caffeine either way
it sounds like something I would get checked out.
Also here are some tips especially for those who live alone

every morning when you wake up say something to yourself out loud
like, Good morning you fantastic wonderful person, say the same thing every morning.
then clap your hands (with both arms elevated)
when you get out of bed are u limping or weak?
then go to a mirror check to see if your face is symmetrical for example, is your eye or mouth drooping on one side?
next, raise your eyebrows, do they both raise symmetrically
next,hows your vision?any blind spots (or other abnormalities in your vision that weren't there before?
next,smile to show your teeth,is your smile symmetrical? (or is one side not smiling at all)
next, stick out your tongue and move it side to side
next, close your eyes hold your arms out in front of you palms up close your eyes count to ten open your eyes has either arm "drifted" downward

congratulations you've just completed a quick neuro check (and i do mean quick)
the most common identifier of a stroke is one sided weakness but there are other smaller signs that call for medical attention as well.
