October 15, 2007 -- WASHINGTON - U.S. intelligence officials got mired for nearly 10 hours seeking approval to use wiretaps against al Qaeda terrorists suspected of kidnapping Queens soldier Alex Jimenez in Iraq earlier this year, The Post has learned.

This week, Congress plans to vote on a bill that leaves in place the legal hurdles in the Foreign Intelligence Surveillance Act - problems that were highlighted during the May search for a group of kidnapped U.S. soldiers.

when you do, remember that:

a) no warrant is needed for foreign to foreign calls

b) this was simply another Bush "administration" screw up....

McConnell told the committee today that restrictions derived by the FISA Court this year on wiretapping foreign-to-foreign communications that pass through the U.S. prevented the NSA from surveilling Iraqi insurgents who had kidnapped U.S. soldiers for 12 hours. But the source, who is privvy to the timeline of the incident, says "internal bureaucratic wrangling," and not court-based restrictions, were responsible for the lag time. "To get an emergency warrant, you just have to believe the facts support the application that someone is an agent of a foreign power," the source says. "That takes approximately five seconds to establish if you're going after an Iraqi insurgent."

The nation's legal traditions over interrogations, detentions, surveillance and every other liberty-security tradeoff made since the Cold War.

Here's a sneak preview:

Readers of Barton Gellman and Jo Becker's Cheney series, "Angler," will be familiar with a lot of this material. The battles fought by Cheney and his longtime legal counsel, David Addington, to expand unilateral executive authority over warmaking functions is the principal thrust of the narrative. But seeing many of the participants tell their stories on camera makes for compelling and vivid journalism. In particular, the documentary devotes a lot of time to Jack Goldsmith, the former Office of Legal Counsel chief who clashed sharply with Addington over interrogations and surveillance. Seeing Goldsmith's frustration, seriousness and occasional anguish adds a layer of complexity to the story that print can't often capture. It's a shame that neither Cheney nor Addington consented to interviews.

But that's not to say that Frontline doesn't advance the story.

It deftly ties the Ashcroft-hospital bed incident to the appointment of Attorney General Alberto Gonzales and the subsequent U.S. attorney firings. Much of the film's final 20 minutes presents the argument that the cronyization of DOJ occurred, with Cheney's blessing, to ensure that the department didn't balk, as Goldsmith and his allies did, over torture or surveillance or indefinite detentions. "It was an effort by the White House to gain control of Justice," New York Times reporter Scott Shane tells Frontline, "to make sure there's no repeat of that rebellion of 2004."

I suspect that the old "Democrats tax and spend" platitude voiced by Republicans has lost its punch to most people outside of the Twenty-Five Percenters. The Twenty-Five Percenters are predominately Hawks who believe that no price is too high for "freedom," but even among the Hawks there are some old school Fiscal Responsibility Republicans who recognize debt when they see it. None of them are dim enough to still believe that oil revenue is going to pay the war bill. Some of them don't care. The rest know that the Piper is going to be paid one way or the other and that both ways will be through taxation of some sort.

A Democratic senator well versed in US intelligence procedures has accused President Bush of "misleading" the American people about the harsh interrogation tactics the CIA uses against terror detainees.

Bush would be willing to accept more than the $5 billion expansion of the program over five years that he requested initially, White House spokesman Tony Fratto said, reacting to comments Sunday by House Speaker Nancy Pelosi, D-Calif. Pelosi told ABC’s “This Week” that Bush had not sought any compromise. “Well, the president made an overture. He made an offer to sit down and find common ground,” Fratto said, adding that it was rejected by congressional leaders. The House will vote Oct. 18 on overriding Bush’s Oct. 3 veto of the bill (HR 976), which would expand the State Children’s Health Insurance Program, or SCHIP, by $35 billion over five years, to $60 billion. The expansion, Democrats say, would provide health coverage to 10 million children whose families are low-income but not poor enough to qualify for Medicaid — about 4 million more than the program now covers. The cost of the expansion would be offset by tobacco tax increases, including a 61-cent increase in the cigarette tax, to $1 per pack. In her appearance on “This Week,” Pelosi said the Democrats would insist on covering “no lower number than 10 million children.”

Front page news about the
"10 hour delay" regarding the Fisa Courts was a laughable yarn.They described lawyers "cobbling" together to get this urgently needed wire tap passed through the court. First off dont they initially get a 72 hour pass in which to pass the Fisa court? Secondly hasn't Bush made it clear they hold the Fisa court in no regard whatsoever anyhow? Plus where did this Kidnapping of Americans in Iraq story all of a sudden drop out of nowhere????????? Funny I hadn't heard of it before it was used to prove that the Fisa Court is killing our boys! Where has the truth gone in this country? Its gone -- all replaced by our "its all a matter of opinion" culture and lying in the media is the way these opinions are spread so really what can anyone do anymore?
