Former Presidents Can't Withhold Records

WASHINGTON (AP) - Presidents don't have indefinite veto power over which records are made public after they've left office, a federal judge ruled Monday.

In a narrowly crafted ruling, U.S. District Judge Colleen Kollar-Kotelly invalidated part of President Bush's 2001 executive order, which allowed former presidents and vice presidents to review executive records before they are released under the Freedom of Information Act.

By law, the National Archives has the final say over the release of presidential records and Kollar-Kotelly ruled that Bush's executive order ``effectively eliminates'' that discretion. It allows former presidents to delay the release of records ``presumably indefinitely,'' she said.

The judge ordered the National Archives not to withhold any more documents based on that section of the executive order.

Congress Poised to Strip 2nd Amendment Rights

H.R.2640 has passed the House with an unrecorded voice vote, and is slated to enter the Senate under a unanimous consent agreement to limit debate. This will, in effect, steamroll the passage of a bill that will serve to strip 2nd Amendment liberties away from citizens diagnosed with mental illnesses.

The bill aims to ease the transfer of mental health records into the National Instant Criminal Background Check System (NICS) database. It will effectively criminalize "a person [who] has been adjudicated as mentally defective or committed to a mental institution" and permanently revoke their ability to own or purchase a firearm. This overly-broad term will criminalize a wide range of mental illnesses, including ADHD, Alzheimer's Syndrome, or Post-Traumatic Stress Disorder. Another source of data will be the records of students identified with behavioral disabilities under the IDEA Program.

This bill is being referred to as the "McCarthy Bill" and is on its way to the Senate floor. Please let your Senator know your feelings about this unjust bill that aims to deprive citizens of their liberties without due process and further stigmatize our veterans and other people with mental health disorders.

It seems to have fallen down the memory hole or been consigned to the purgatory of forgotten news stories: the indictment of Steve Rosen nd Keith Weissman, two top officials of the American Israel Public Affairs Committee (AIPAC). More than three years ago, the news that Rosen, the number-one lobbyist for Israel in Washington, and his sidekick Weissman had been indicted for violating the Espionage Act, for handing over top-secret intelligence to Israeli embassy officials, broke like a thunderclap over official Washington. Today, its echoes have petered out almost entirely, as news of the case has sunk so far beneath the media's radar that developments in what is an important and fascinating story are no longer reported. I'll do my best to rectify that.

But first, one has to wonder, why is the veil of silence being drawn over this extraordinary affair? After all, the story involves what Time magazine called "among the most politically charged espionage cases in years" – surely a newsworthy topic. Why no follow-up?

It's very odd. Don't forget that AIPAC, the premier pro-Israel lobby in the country and one of the most powerful and feared of Washington's movers and shakers, was subjected to no less than two humiliating FBI raids on its Washington offices: desks were searched and emptied and computers carted away, while a cordon of agents prevented anyone or anything from leaving or entering the area until the operation was over. All AIPAC employees were, presumably, questioned. You don't see that kind of action unless there is something very substantial behind it.

Obey plans fight over war funding. House Appropriations Chairman David Obey (D-WI) said today that he will not report out a war supplemental spending bill this year unless the White House makes drastic changes in its Iraq strategy. Obey demanded three conditions: 1) the White House would have to establish a goal to end U.S. involvement in the country, 2) ensure that troops receive adequate downtime between deployments, and 3) begin a “broad scale diplomatic offensive” involving other countries in the region. Obey also said he will soon unveil a “surtax,” designed to raise $140 billion to $150 billion. “We need to stop pretending that this war doesn’t cost anything,” he said.

The potential for Obama is pretty obvious to see, even for an Edwards supporter like myself. Even as Rubin dismissed Edwards and his populist run, he was very animated about Obama. Checking the internet I saw Obama spoke at the opening of the Hamilton Project. I'm wondering how involved this group is with Obama. I must admit, I checked the fundrace site and Mrs. Rubin seems to have donated the primary maximum to Obama.

Happy days are here again, at least for the stock market. The Dow Jones Industrial Average, the world’s most venerable stock index, on Monday morning went above its previous all-time record close, set on July 19.

Since then, money and credit markets have been turned inside out and the dollar has collapsed. Citigroup, one of the 30 stocks in the Dow, on Monday revealed the extent of the damage to its bottom line: earnings for the third quarter will be 60 per cent below the level last year, owing to a $1.3bn loss in the credit markets.

But the stock market took the Citi announcement as drawing a line under the credit squeeze. It had been braced for worse.

Why such a strong rally? Many believe we are replaying the last “emergency” Fed rate cut from October 1998, in the wake of the Long-Term Capital Management debacle. That cut super-charged markets that had no need of easier money. In the first 30 trading days after that cut, the Nasdaq Composite gained 23.2 per cent. It went on to form the tech bubble.

Now, in the 30 trading days since the credit squeeze forced the Fed to cut the rate at which it lends to banks, the MSCI emerging markets index has done even better, gaining 25.8 per cent. As in 1998, the theory is that the cut will help pour money into a sector that was already showing signs of delivering secular growth.

The Dow’s resurgence shows more confidence in the rest of the world than in the US. Since it peaked on July 19, the best Dow stock is Procter & Gamble – a consumer group with steady demand for its products which gains from a weak dollar because it sells all over the world. It is up 12.75 per cent.

The worst performer, down 16.3 per cent, is Home Depot, which is primarily a play on the US. A consumer-led recession would clobber its profits. This Dow peak reflects bullishness on emerging markets, but not on the dollar or the US economy.

The private security firm Blackwater USA, which has faced mounting criticism following an incident earlier this month in which armed guards from the group purportedly killed 11 unarmed Iraqi civilians, has numerous links to the White House as well as many current and former Republicans.

The connections include the firm's chief operating officer Joseph Schmitz, who was tapped by President Bush in 2002 to "oversee and police the Pentagon's military contracts as the Defense Department's Inspector General."

The relevation was first reported by Ben Van Heuvelen in Salon.

Serving until 2005, Schmitz went on to preside over "the largest increase of military-contracting spending in history" and joined Blackwater just a month after his departure from the Pentagon, according to Van Heuvelen.

"The resignation comes after Sen. Charles Grassley (R-IA) sent Schmitz several letters this summer informing him that he was the focus of a congressional inquiry into whether he had blocked two criminal investigations last year," according to a 2005 article in the LA Times.

Then-Chairman of the Senate Finance Committee, Grassley "accused Schmitz of fabricating an official Pentagon news release, planning an expensive junket to Germany and hiding information from Congress. Schmitz is the senior Pentagon official charged with investigating waste, fraud and abuse."

Blackwater CEO Erik Prince will testify today before the House Oversight and Government Reform Committee in a hearing centered on the use of private contractors in Iraq -- but the appearance was at first contested by the State Department, who Van Heuvelen said "directed Blackwater not to give any information or testimony without its sign-off." Secretary of State Condoleeza Rice later agreed that Prince could testify.

Iranian Foreign Ministry spokesman said on Sunday that he supported the recent Majlis (parliament) statement to brand the U.S. army and the Central Intelligence Agency (CIA) as terrorist groups.

What happens in a minute?

In the Iraq war – as in any war -- lives are ended and destroyed, homes are demolished and families are broken within the space of a minute. And, according to a new analysis by the American Friends Service Committee (AFSC), the U.S. is spending half a million dollars each minute of the war. In a day, the toll comes to $720 million. The group based its figures, unveiled in “Cost of War” exhibits in major US cities on Sept. 20 and 21, on the work of former World Bank chief economist Joseph E. Stiglitz and Harvard public finance lecturer Linda Bilmes.

On large banners placed in downtowns in Philadelphia, Chicago, Boston, San Francisco, Sioux City, a Baltimore suburb and other locations, the AFSC showed the trade-off in social services and resources in terms of “war dollars.”

The cost of one day of the Iraq war, they say, could:

create over 95,000 Head Start slots for kids,

buy 6,482 homes for families,

provide healthcare for 423,529 children or 163,525 people,

hire 12,478 elementary school teachers,

outfit 1.27 million homes with renewable electricity,

sponsor almost 35,000 four-year college scholarships or

So writes Anita Hill in Tuesday's New York Times, the woman whose sexual harrassment charges unsettled the nomination hearings of Clarence Thomas some 16 years ago.

Addressing his new book, “My Grandfather’s Son," Hill, a Brandeis sociology professor currently in residence at Wellesley, writes, "I will not stand by silently and allow him, in his anger, to reinvent me."

"Justice Thomas offers a litany of unsubstantiated representations and outright smears that Republican senators made about me when I testified before the Judiciary Committee — that I was a “combative left-winger” who was “touchy” and prone to overreacting to “slights,” she says. "A number of independent authors have shown those attacks to be baseless. What’s more, their reports draw on the experiences of others who were familiar with Mr. Thomas’s behavior, and who came forward after the hearings. It’s no longer my word against his."

In his book, Thomas portrays Hill's attack as part of a campaign by special interest groups Powerful interest groups to use "the age-old blunt instrument of accusing a black man of sexual misconduct."

Among the more striking parts of Hill's testimony (which can be read here), is when Thomas allegedly asked her about pubic hair on his Coca-Cola.

"One of the oddest episodes I remember was an occasion in which Thomas was drinking a Coke in his office," she stated. 'He got up from the table at which we were working, went over to his desk to get the Coke, looked at the can and asked, 'Who has pubic hair on my Coke?' On other occasions, he referred to the size of his own penis as being larger than normal, and he also spoke on some occasions of the pleasures he had given to women with oral sex."

In her op/ed, Hill contests in detail Thomas' allegations about her employment.

WASHINGTON - American laboratories handling the world's deadliest germs and toxins have experienced more than 100 accidents and missing shipments since 2003, and the number is increasing steadily as more labs across the country are approved to do the work.

No one died, and regulators said the public was never at risk during these incidents. But the documented cases reflect poorly on procedures and oversight at high-security labs, some of which work with organisms and poisons so dangerous that illnesses they cause have no cure. In some cases, labs have failed to report accidents as required by law.

The mishaps include workers bitten or scratched by infected animals, skin cuts, needle sticks and more, according to a review by The Associated Press of confidential reports submitted to federal regulators. They describe accidents involving anthrax, bird flu virus, monkeypox and plague-causing bacteria at 44 labs in 24 states. More than two-dozen incidents were still under investigation.

The number of accidents has risen steadily. Through August, the most recent period covered in the reports obtained by the AP, labs reported 36 accidents and lost shipments during 2007 — nearly double the number reported during all of 2004.

Research labs have worked for years to find cures and treatments for diseases. However, the expansion of the lab network has been dramatic since President Bush announced an upgrade of the nation's bio-warfare defense program five years ago. The National Institute of Allergy and Infectious Diseases, which funds much of the lab research and construction, was spending spent about $41 million on bio-defense labs in 2001. By last year, the spending had risen to $1.6 billion.

Two bits of testimony Prince would come to regret: He said earlier today that Blackwater gets about 90 percent of its business from federal contracts, and he said that, "as an example," under some of the contracts Blackwater has, it earns about a 10 percent profit margin. But Prince balked at saying how much money Blackwater actually makes in Iraq. Since the beginning of the war, Blackwater has been awarded contracts worth roughly $1 billion. "We're a private company," he said. "The key word there is private."

Reps. Peter Welch (D-VT) and Christopher S. Murphy (D-CT) pounded on the question. "How can you say that information isn't relevant?" Murphy said, saying "my constituents pay 90 percent of your salary. Welch, "just trying to do the math," pointed out that 10 percent of $1 billion is $100 million, but Prince repeatedly backed off the figure, saying that he couldn't factor in "depreciation" off the top of his head for when, for instance, Blackwater loses armored cars or helicopters. Murphy said Prince's plea of ignorance is "hard to believe."

Prince's reply? "I'm not a financially driven guy." He did, however, offer that, last year, his salary was in the ballpark of $1 million.
